Sotelo, City :Manage .�& SUBJECT: Hutton/Luque Community Centers Expansion Date: December 12,1990 Projects, additional amenities in lieu of liquidated damages. Shook Building Svstem, Inc. Background : Per the contract documents, signed agreement and change orders, the time to complete the afore mentioned project expired September 24,1990. The contractor was notified of the expiration and subsequent deduction of liquidated damages from the contract specified and agreed upon in the supplementary conditions of said contract. The contractor utilized additional thirty(30) days to substantially complete the project. Per the certificate of substantial completion the contractor stipulated and attested that twenty-one(21) days would be required to complete all punch list items and have the project complete for Council final. This time span expired November 14, 1990. The contractor was notified of the expiration and subsequent continuance of liquidedated damages deductions as specified and agreed upon in the supplementary conditions of said contract. The Project was occupied by the City on November 19,1990 for beneficial use prior to project final as allowed per the General Conditions of the Contract. Said occupancy ended the liquidated damages phase of the contract. In light of the amount of accrued liquidated damages and specific requests for items to be acc some time added to the facilities, staff endeavored to negotiate with the contractor and submitted to same, a propostal for additional amenities to be provided in lieu of liquidated damages.
