La Cadena Dr. <br />Colton, CA 92324 <br />Re: Centrepointe Drive <br />Dear Mr. Hutton: <br />8383 Wilshire Boulevard, Suite 800 <br />Beverly Hills, California 90211 <br />c/o Box 001 <br />Beverly Hills, California 90210 <br />(213) 852-0499 <br />First City is the owner of the 42 acre Centrepointe Project located <br />in the City of Colton, bounded by Mt. Vernon Avenue and the 215 <br />freeway. First City is currently under contract to sell <br />approximately 24 acres of the project to Gatlin/Berger Development, <br />Inc. In connection with the Gatlin/Berger development, it has been <br />proposed that Centrepointe Drive be vacated. I am advised that this <br />matter is scheduled for approval by the city council on July 3, 1990. <br />As I indicated to Lorraine, since the vacation is being proposed <br />solely in connection with the Gatlin/Berger development, First City <br />is requesting that the vacation be conditioned upon Gatlin/Berger's <br />purchase of the 24 acres, such that if the purchase does not occur <br />the vacation will not be effective. We also feel it is appropriate <br />that the documents evidencing the vacation should not be recorded <br />until the Gatlin/Berger purchase has occurred. To simplify matters, <br />we suggest that the vacation documents be recorded through the escrow <br />which is handling the sale to Gatlin/Berger (Ticor Title Insurance - <br />San Bernardino office). <br />I would appreciate if you could forward to me the proposed resolution <br />regarding the vacation, incorporating the above request, for my <br />review. <br />If you have any questions regarding this matter, please feel free to <br />call me.
