=z 1989-1990 REGULAR SESSION <br />Ch. 545 <br />21305. (a) A beneficiary may apply to the court for a determination whether a <br />particular motion, petition, or other act by the beneficiary would be a contest within the <br />terms of a no contest clause. <br />(b) A no contest clause is not enforceable against a beneficiary to the extent an <br />application under subdivision (a) by the beneficiary is limited to the procedure and <br />purpose described in subdivision (a) and does not require a determination of the merits of <br />the motion, petition, or other act by the beneficiary. <br />(c) A determination of whether Section 21306 or 21307 would apply in a particular case <br />may not be made under this section. - <br />21306. A no contest clause is not enforceable against a beneficiary to the extent the <br />beneficiary, with probable cause, brings a contest that is limited to either or both of the <br />following grounds: <br />1 (a) Forgery. <br />(b) Revocation. <br />21307. A no contest clause is not enforceable against a beneficiary to the extent the <br />beneficiary, with probable cause, contests a provision that benefits any of the following <br />persons: <br />(a) A person who drafted or transcribed the instrument <br />(b) A person who gave directions to the drafter of the instrument concerning disposi- <br />tive or other substantive contents of the provision. or who directed the drafter to include <br />the no contest clause in the instrument, but this subdivision does not apply if the <br />transferor affirmatively instructed the drafter to include the contents of the provision or <br />the no contest clause. <br />% (c) A person who acted as a witness to the instrument <br />COMMUNITY REDEVELOPMENT LAW—LAND ADJACENT TO NORTON <br />AND GEORGE AIR FORCE BASES <br />CHAPTER <br />A.B.No. 419 <br />AN ACr to add Section 333205 to, the Health and Safety Code, relating to redevelopment. <br />[Approved by Governor September 20, 1989.] <br />[idled with Secretary of State September 21, 1989.] <br />LEGISLATIVE COUNSELS DIGEST <br />AB 419, Eaves. Redevelopment <br />Under the existing Community Redevelopment Law, territory included within a project <br />area, with specified exceptions, is required to be a predominantly urbanized area of a <br />community, as defined, which is -a blighted area, the redevelopment of which area is <br />necessary to effectuate the public purposes specified in the Community Redevelopment <br />IAWw <br />This bill would make an exception to the application of thisTprovision in the case of a <br />project area containing privately owned land adjacent to, or in close proximity to, as <br />defined, Norton and George Air Force Bases which are proposed .to be closed by the <br />federal government pursuant to Public Law 100-526..
