d <br />Provided, however, no such payment shall be made if his removal is by reason <br />of his disability, death or other inability or failure to perform his duties <br />or his absence from Colton or conviction of a crime; and, provided further, <br />that no such payment shall be made if he contests or refuses in any manner <br />to accede to such removal. <br />(7) EXTENSION. In the event that neither party notifies the other in writing at <br />V(`* least four (4) months before the termination date that the termination date shall <br />not be extended, then upon such failure to notify, the termination date shall <br />be extended for one (1) year. <br />(i (8) GENERAL PROVISION <br />(a) This Agreement shall constitute the entire Agreement between the parties. <br />(b) This Agreement shall become effective upon approval by a majority vote of <br />the City Council. <br />(9) NOTICES. Notices pursuant to this Agreement shall be given by deposit in the <br />custody of the United States Postal Service, postage prepaid, to: <br />(a) Mayor & City Council <br />City of Colton <br />650 N.
