Sotelo, City Manager <br />SUBJECT: Repeal of Senate Bill 2557, Charging For Booking of Prisoners DATE: October 11, 1990 <br />BACKGROUND <br />When Governor Deukmejian and the State Legislature approved the 1990 state budget, they underfunded counties <br />hundreds of millions of dollars and told counties to make up the difference by charging the cities for services, including <br />charging each city to book prisoners into the county jail system. <br />Senate Bill 2557 imposes a state mandated local program by authorizing the county to impose a fee upon other local <br />agencies for county costs incurred in processing or booking persons arrested by employees of the local police agencies <br />brought to the county facility for booking or detention. This charge may be retroactive to July 1, 1990. What this means <br />to Colton is the County of San Bernardino will charge the city of Colton for each arrestee booked into the San Bernardino <br />County Jail. Colton Police Department is a detention facility only and, by law, must utilize the booking facilities of the San <br />Bernardino County Jail. San Bernardino County intends to charge the City of Colton between $125 and $150 per person <br />booked into the San Bernardino County Jail. <br />ALTERNATIVES <br />Colton could accept the $750,000 charge by the County of San Bernardino. The Colton Police Department could reduce <br />the number of arrests which require booking. A new city jail staffed by officers, cooks, medical personnel and supporting <br />clerical staff could be incorporated into the police department. None of these alternatives is acceptable. <br />FINANCIAL IMPACT <br />In 1988 Colton Police Department arrested 2,695. At $150 per booking, Colton would have paid San Bernardino County <br />$404,250. In 1989 Colton Police Department arrested 3,407 adults, a 26% increase. Colton would have paid San <br />Bernardino County $511,050.
