91-117386 <br />neglect to commence the installation of said improvements within <br />one week after the aforesaid 30 days notice, or to finish the <br />installation within a reasonable period of time, CITY may at its <br />expense by separate contract or force labor accomplish the installa- <br />tion and construction of said improvement and POPE <br />shall be liable to CITY for its costs thereof including, but not <br />limited to overhead, labor and material. Said liability shall be a <br />lien of the real property described herein. <br />4. The notice hereinabove referred to shall be considered <br />effective and delivered when mailed addressed to MR & MRS. POPE <br />at 890 N. PENNSYLVANIA AVE. Colton <br />California, or such other places as POPE <br />or his successor in interest shall notify CITY in writing to send <br />said notice. <br />5. This agreement shall constitute a recordable covenant running <br />with the land and shall be binding upon the heirs, executors, admin- <br />istrators and successors and assigns of the parties hereto. <br />6. The CITY agrees to issue the requested Building Permit. <br />IN WITNESS WHEREOF, the parties aforesaid set their hands as <br />of the date and year of this agreement first hereinabove written. <br />3 <br />
