VEHICLE CODE LAWS <br />Some laws are expressed in general terms, and have wide application. One of <br />these is section 24002 CVC: <br />24002. It is unlawful to operate any vehicle or <br />combination of vehicles which is in an unsafe condition, which <br />isnot equipped as required by this code, or which is not <br />safely loaded. <br />This section addresses three separate issues: (1) safe condition of vehicles; <br />(2) vehicles being equipped as required; and (3) vehicles being safely <br />loaded. This law applies to any vehicle on California highways, not just <br />those which are subject to the additional regulations of the CHP. The same is <br />true of other equipment and maintenance requirements found in the Vehicle <br />Code. Many sections limit their own application to certain types of vehicles. <br />13 CCR REGULATIONS <br />Vehicles listed in 34500 CVC are subject to regulations in Subchapter 6.5, 13 <br />CCR. One of the general requirements which applies to all vehicles subject to <br />Subchapter 6.5, 13 CCR, is the requirement for motor carriers to maintain <br />those vehicles in proper operating condition, and to do so in a systematic <br />manner. In other words, motor carriers must have a Preventive maintenance <br />program for those vehicles. Section 1232 (a) of that code states: <br />1232. Vehicle Inspection and Maintenance. <br />The following provisions apply to the inspection and <br />maintenance of vehicles subject to this subchapter. <br />(a) Preventive Maintenance. Motor carriers shall ensure <br />that all vehicles subject to their control, and all required <br />accessories on the vehicles., are ,regularly and systematically <br />inspected, maintained, and lubricated to ensure they are in <br />safe and proper operating condition. The carriers shall have <br />a means of indicating the typesof inspection, maintenance, <br />and lubrication operations, to be performed, on each vehicle and <br />the date or mileage when these operations are due. The <br />inspection required by this subsection is more in depth than <br />the daily inspection performed by the driver. Motor carriers <br />shall ensure: compliance with this subsectionrwhen a vehicle is <br />assigned away from the carrier's regular maintenance facility <br />for periods exceeding normal inspection, maintenance, and <br />lubrication intervals. <br />WHAT IS PREVEWTIVE MAINTENANCE? <br />A preventive maintenance program is a regularly scheduled program for <br />inspections of trucks, trailers, buses or other vehicles subject to these <br />regulations.
