CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of November 5, 1991 <br />TO: Honorable Mayor and City Council <br />FROM: Leslie Keane Stratton, City Manager <br />SUBJECT: l Date: 10/31/91 <br />Modifications To Refuse Collection <br />Regulations And Franchise Requirements <br />BACKGROUND: <br />The City of Colton has its own Refuse Collection Department, but for <br />numerous years has also issued franchises to private haulers who wish to <br />do business in the City. The City currently has the exclusive right to <br />collect residential refuse unless it determines that the service can be <br />provided better by a private hauler. The City must compete, however, for <br />commercial and industrial business. Apartment and condominium complexes <br />are considered commercial accounts. In April 1990, the City notified <br />existing haulers that effective April 1995 it would modify the way it <br />issued refuse collection franchise, and that such modifications might <br />include exclusive City collection or a single franchisee. <br />DISCUSSION• <br />The adoption of AB 939 requires the City to assume an active role in <br />regulating refuse collection, both public and private collection. This <br />is difficult to accomplish with multiple haulers who are consistently <br />competing for business and changing their client base. The City's <br />current refuse collection franchise regulations promotes open and <br />continuing competition. Staff is proposing (Ordinance #1 attached) to <br />limit current haulers to their existing client base. New development <br />and/or service changes would be handled by City services or by specific <br />contract between the City and an individual hauler. <br />Currently three refuse haulers are licensed to operate in the City of <br />Colton; in its 1990 action Council directed staff not to issue additional <br />franchises. The City's initial decision to give a five year notifica- <br />tion of its intent to modify the refuse collection franchise process was <br />based on State Public Resources Code Section 49520. Section 49521of the <br />Public Resources Code, however, provides an exception to the five year <br />notice in instances where a city does not periodically review or set <br />rates charged by refuse haulers.
