Aguilera, Director of Community Developmenf4_� G <br />SUBJECT: Appeal of Planning Commission Decision - <br />File Index Number DCV -33-91; Regency Outdoor Advertising. <br />E <br />BACKGROUND: <br />During the Planning Commission's Public Hearing, our Assistant City Attorney's opined N <br />that the Planning Commission had no authority to approve the applicant's request because <br />it was in conflict with an already approved request by Adams Advertising and because <br />Caltrans approvals, and evidence of a possessing interest in the land, are a prerequisite <br />to approval. The Planning Commission denied the application and the matter has been <br />appealed.
