02/03/92 11:20 $8854407 SANBAG 0'.,002 _ BARTON ROAD/HUNTS LANE INTERSECTION RECONSTRUCTION/REALIGNMENT PROJECT CONSTRUCTION MANAGEMBNT AND FUNDING AGREMENT (Contrast Number 92-012) THIS AGREEWENT, matte and entered into this _ day of , 1992, by and between the SAN BERNARUINO COUNTY TRANSPORTATION AUTHORITY, hereinafter referred to as *, NBAG", and the CITY OF COLTON, hereinafter referred to as W7IEREAS, SANBAG and CITYconsider that the improvement of the reconstruction and realignment of the Barton Road/Hunts Lane intersection area is a high priority project; and WAfIEREA,S, the reconstruction and realignment of the Barton Road/Hunts Lane intersection will improve safety; and WHEREAS, the Barton Road/Hunts Lane intersection was on the priority list for funding from the Combined Road Program; and WHEREAS, funding for the reconstruction and realignment of the Barton Road/Hunts intersection is currently unavailable from the Combined Road Program; and W7IERF_A.S, on August 7, 1991, SANBAG approved a loan to CITY of $755, 000 from the Valley Measure I Program to advance the reconstruction and realignment of the Barton Road/Hunts Lane intersection; and WHERFAS, the SANBAG loan of $755,000 is to be repaid by the CITY through any local Ands received from the Intermodal Surface Transportation Act of 1991, Measure I Local Funds, or from other local sources by lune 30, 1995; and WBERE45, the precise alignment and design of the Barton Road/Hunts Lane Intersection, hereinafter described as "PROJECT", has been completed and includes construction of infrastructure improvements along Barton Road between Hunts Lane and Reche Canyon Road, within "CIM; and WHEREAS, CITY has retained a consultant to provide construction engineering and inspection of the PROJECT, as outlined under Scope of Fork, Exhibit 'B" attached hereto, to ensure the PROJECT will be constructed in compliance with the plans and specifications entitled
