4. Except as hereinafter provided, the CITY shall furnish <br />all personnel, equipment, supplies, and administrative support <br />services necessary to operate the Child Care Program provided for <br />herein. The CITY shall provide adequate adult supervision and <br />inform and train participants on playground rules and the safe use <br />of same. <br />5. The DISTRICT will provide for the use of the CITY at each <br />location noted and described in paragraph 2 hereof space as is <br />required to conduct the Child Care Program; provision of ground <br />space for the CITY to place a classroom facility if need warrants, <br />playground areas necessary to conduct the Child Care Program, <br />custodial maintenance of the space needed to conduct the Child Care <br />Program; access to all restroom facilities at all times when the <br />Child Care Program is being conducted. Keys to the designated <br />facilities shall be delivered to the appropriate officials in the <br />Human Services Division of the CITY. The keys shall be returned to <br />the DISTRICT upon demand. The CITY shall not remove, alter, or add <br />to any facility or grounds used by the Child Care Program without <br />prior approval of the DISTRICT. <br />6. The DISTRICT facilities are in "as is" condition. It is <br />the responsibility of the CITY to inspect the DISTRICT'S buildings <br />and/or grounds to determine its appropriate and safe use for all <br />activities and participants. The CITY shall also have the <br />responsibility to take affirmative steps to repair or, where <br />necessary, warn in order to prevent injury to person or property. <br />7. The DISTRICT shall not assess any charge for the use of <br />facilities used by the CITY to provide the Child Care Program. <br />Regular employees of the DISTRICT shall be provided child care <br />services on minimum/conference days on an occasional basis, <br />provided that the employee provides the CITY advance notice of <br />child's attendance, is eligible to attend the program, and agrees <br />to adhere to the Child Care Program's guidelines. <br />8. The CITY shall indemnify and save the DISTRICT free and <br />harmless of and from any and all costs, expenses, claims, demands, <br />suits, actions, or judgements made, brought, or recovered against <br />the DISTRICT and the Board of Education of the DISTRICT or either <br />of them, for personal injuries, death, or property damage including <br />the property of the DISTRICT, resulting from any negligent act or <br />omission of the CITY, its agents, servants, or employees in <br />connecting with the performance of this Agreement. The CITY being <br />self-insured for liability, shall institute and maintain at all <br />times relevant an appropriate self-insurance reserve. <br />
