1 <br />ORDINANCE NO. 0-13-92 <br />2 <br />AN ORDINANCE OF THE CITY OF COLTON ADDING <br />3 CHAPTER 9.14 TO THE COLTON MUNICIPAL CODE <br />4 REGULATING PUBLICLY DISPLAYED EXPLICIT ADULT <br />MATERIALS DEFINED AS HARMFUL MATTER <br />5 <br />6 <br />7 WHEREAS, the interest of the City of Colton (the "City") in protecting the public health, safety <br />8 <br />and welfare of the City and its citizens supports the necessity to protect minors from viewing <br />9 <br />publicly displayed material that is defined as harmful matter; and <br />10 <br />11 <br />12 WHEREAS, the California Penal Code at Section 313(a) defines harmful matter as that which <br />13 lacks significant value for minors, and is therefore unsuitable for minors, and <br />14 <br />15 WHEREAS, the California Penal Code at Section 313.1(d) authorizes cities to adopt ordinances <br />16 <br />which restrict the display of harmful matter to minors by the use of blinder racks; <br />17 <br />18 <br />19 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES HEREBY <br />20 ORDAINAS FOLLOWS:. <br />21 <br />22 <br />Section 1. Chapter 9.14 is hereby added to the Colton Municipal Code to read as follows: <br />23 <br />Chapter 9.14 <br />24 <br />25 BLINDER RACKS <br />26 Sections: <br />27 9.14.010 Definitions. <br />28 9.14.020 Requirement of Blinder Racks. <br />9.14.030 Penalty. <br />
