1 <br />9.14. 010 Definitions. For the purposes of this chapter, unless otherwise <br />2 <br />stated, certain words and phrases used in this chapter are defined as follows: <br />3 <br />4 <br />A. 'Person" means any individual, partnership, firm, association, <br />5 <br />corporation, or other legal entity. <br />6 <br />B. 'Minor" means any natural person under 18 years of age. <br />7 <br />C. 'Matter" means any boob magazine, newspaper, video recording, <br />8 <br />or other printed or written material or any picture, drawing, photograph, motion <br />9 <br />picture, or other pictorial representation or any statue or other figure, or any <br />10 <br />recording, transcription, or mechanical, chemical, or electrical reproduction or any <br />11 <br />12 <br />other articles, equipment, machines, or materials. <br />13 <br />D. 'Harmful matter" means matter, taken as a whole, which to the <br />14 <br />average person, applying contemporary statewide standards, appeals to the <br />15 <br />prurient interest, and is matter which, taken as a whole, depicts or describes in <br />16 <br />a patently offensive way sexual conduct and which, taken as a whole, lacks <br />17 <br />serious literary, artistic, political, or scientific value for minors. <br />18 <br />19 <br />E. 'Exhibit" means to show or display. <br />20 <br />F. 'Blinder rack" means an opaque piece of material or other device, <br />21 <br />which when placed in front of materials providing a public display of harmful <br />22 <br />matter serves to completely obscure the harmful matter, and which is placed in <br />23 <br />such manner that it obscures at least the lower two-thirds portion of the harmful <br />24 <br />25 <br />material from exposure to view. <br />26 <br />27 <br />28 <br />DIAV <br />7951 <br />
