CITY OF COLTON <br />AGENDA REPORT <br />For Council Meeting of October 20. 1992 <br />TO: Honorable Mayor and City Council <br />FROM: Gar Decker, Public Utilities Director <br />SUBJECT: Acceptance of the Wastewater Treatment Plant 1990-91 Date: October 8, 1992 <br />Replacement Facilities Project as 100% Complete, and <br />Authorize the Filing of the Notice of Completion <br />BACKGROUND! <br />On July 16, 1991 Council awarded a construction contract for the replacement of <br />facilities at the wastewater treatment plant to Vido Samarzich, Inc. <br />DISCUSSION: <br />The project construction work has now been completed. However, the contractor caused <br />delays that resulted in the construction extending beyond the contract period. <br />Krieger and Stewart, the consulting engineers on the project have recommended that <br />the project be accepted as 100% complete (recommendation attached), however, they <br />also have recommended that the City retain $16,000.00 in liquidated damages <br />resulting from the contractor exceeding the contract time frame by 32 days. Jack <br />Schroeder, Interim Public Utilities Director, negotiated with Vido Samarzich, and <br />both parties agreed to $12,000.00 in liquidated damages for 24 days delay in <br />completing the project. <br />Staff concurs with the recommendation for liquidated damages negotiated by Jack <br />Schroeder and Vido Samarzich. <br />RECCMMENDATION: <br />Staff recommends that Council accept the Wastewater Treatment Plant 1990-91 <br />Replacement Facilities as 100% complete, and approve the liquidated damages in <br />the amount of $12,000.00, and authorize the Public Utilities Director to file the <br />notice of completion. <br />/ 1 j <br />CITY MANAGER'S CONCURRENCE - <br />Attachments <br />Page 1 of <br />r� <br />Item No. -3. <br />
