CITY OF COLTON AGENDA REPORT For Council Meeting of October 20. 1992 TO: Honorable Mayor and City Council FROM: Gar Decker, Public Utilities Director SUBJECT: Acceptance of the Wastewater Treatment Plant 1990-91 Date: October 8, 1992 Replacement Facilities Project as 100% Complete, and Authorize the Filing of the Notice of Completion BACKGROUND! On July 16, 1991 Council awarded a construction contract for the replacement of facilities at the wastewater treatment plant to Vido Samarzich, Inc. DISCUSSION: The project construction work has now been completed. However, the contractor caused delays that resulted in the construction extending beyond the contract period. Krieger and Stewart, the consulting engineers on the project have recommended that the project be accepted as 100% complete (recommendation attached), however, they also have recommended that the City retain $16,000.00 in liquidated damages resulting from the contractor exceeding the contract time frame by 32 days. Jack Schroeder, Interim Public Utilities Director, negotiated with Vido Samarzich, and both parties agreed to $12,000.00 in liquidated damages for 24 days delay in completing the project. Staff concurs with the recommendation for liquidated damages negotiated by Jack Schroeder and Vido Samarzich. RECCMMENDATION: Staff recommends that Council accept the Wastewater Treatment Plant 1990-91 Replacement Facilities as 100% complete, and approve the liquidated damages in the amount of $12,000.00, and authorize the Public Utilities Director to file the notice of completion. / 1 j CITY MANAGER'S CONCURRENCE - Attachments Page 1 of r� Item No. -3.
