Upon 30 days written notice by CITY to Singletary or <br />successors in interest to commence the construction and <br />installation of said off-site and street improvements, namely <br />Pellisier Street improvements and on site improvements 32 foot wide <br />private road easement from Pellisier to remainder parcel as shown <br />on Parcel Map 14405 he and or they will do so in accordance with <br />plans and installation of said off-site improvements, he and or <br />they will do so in accordance with plans and specifications <br />approved by CITY according to code, ordinances and policies then <br />applicable or in accordance with the aforementioned public <br />utilities improvement district to accomplish said construction as <br />expeditiously as reasonably possible. The construction and <br />installation of said off-site and on-site improvements shall be at <br />no cost whatsoever to CITY. <br />3. In the event Singletary or successor in interest shall <br />refuse or neglect to commence the installation of said improvements <br />within one week after the aforesaid 30 days notice, or to finish <br />the installation within a reasonable period of time, CITY may at <br />its expense by separate contract or force labor accomplish the <br />installation and construction of said improvement and Singletary or <br />successor in interest shall be liable to CITY for its costs thereof <br />including, but not limited to overhead, labor and material. Said <br />liability shall be a lien on the real property described herein, <br />as a condition of said parcel map. <br />4. Singletary or successors in interest agree to the formation <br />of a public improvement utility district for permanent water and <br />sewer system, and agree to be a party to the public improvement <br />
