LAW OFFICES OF <br />BEST, BEST b� KRIEGER <br />�EMORANDUM <br />TO: Mayor, City Council and City Manager <br />FROM: City Attorney <br />; . �.. <br />�-, �,: <br />f��.�, `� <br />Pi,.y <br />January 12, 1993 <br />RE: Appoint�nent of Commission Members by District <br />INTRODUCTION <br />The City has established several commissions by <br />ordinance. Th�e City Council inquires as to whether it may appoint <br />members to the various commissions by district. <br />DISCUSSION <br />Under Article XI, Section 7 of the California <br />Constitution, the City Council has the authority to amend <br />the Colton Municipal Code to address the composition of commission <br />members. <br />In order to require that commission appointments be made <br />by district, the City Attorney would have to review each section of <br />the Colton Municipal Code establishing a particular commission. <br />Ther�after, the City Attorney would have to prepare an ordinanc.e <br />which establishes that the appoin�ment of inembers to a particular <br />commission shall be by district. <br />Under California Government Code sect;nn ��q�d t�,o <br />ordinance would be subject to a first and second reading and could <br />take effect 60 days after introduction to the City Council. <br />At the direction of the City Council we would be happy to <br />prepare an appropriate ordinance reflecting the desire of the City <br />Council regarding this matter. <br />GPS148163 <br />
