RECITALS The sante Ana Watershed Project Authority ( "SAWPA" ) ie engaged in the construction of the Santa Ana Regional Intorceptor ("SARI") for th© tratnsmiesion of industrial waste water and has allocated a SARI pipeline capacity use right to SBVHWD contingent on payment therefor. SAWPA and SBVMWD have prepared a propeCed SARI Capaoity Agreement under which SDVMWD will acquire such capacity use right and related rights upon the terms and subject to the obligations contained therein.
