provisions prescribed in the "Special Assessment Investigation, <br />Limitation and Majority Protect Act of 1931," being Section 2804, <br />Division 4 of the Streets & Highways Code; and the City Council <br />intends that said Improvements be completed without further <br />reference to or application of the provisions of said Division 4 <br />of the Code. <br />8. Pursuant to Section 10301 of the Streets and Highways <br />Code and Section 54954.6 of the Government Code, this City <br />Council hereby sets a public hearing for April 19, 1994 at the <br />hour of 7:00 p.m. (or as soon thereafter as the matter can be <br />heard) and a public hearing for May 17, 1994 at the hour of <br />7:00 p.m. (or as soon thereafter as the matter can be=heard), in <br />each case in the City Council Chambers, 650 North La Cadena <br />Drive, Colton, California 92324. At such times, this City <br />Council will hear any protests regarding the above-described <br />assessments relating to the Assessment District. This City <br />Council hereby designates the Sun Telegram as the newspaper in <br />which a notice of the public hearings shall be published, and <br />this City Council directs the appropriate officers of the City to <br />give all notices of such hearings as required by Section 54954.6 <br />of the Government Code. <br />9. This Council hereby declares that the territory within <br />the boundaries hereinafter specified and described is the <br />Assessment District to be benefited by said improvements and to <br />be assessed to pay the cost and expenses thereof; that the <br />improvements are of more than local or ordinary public benefit <br />and the cost and expenses of said improvements shall be made <br />chargeable upon said Assessment District; and that the exterior <br />boundaries of said Assessment District are hereby specified and <br />described to be as shown generally in the petition and more <br />particularly shown on a map thereof on file in the office of the <br />Community Development Department, to which reference is hereby <br />made for further particulars. The map indicates by a boundary <br />line the extent of the Assessment District. <br />10. To the extent that work, rights, improvements or <br />acquisitions indicated in the Engineer's Report, to be made as <br />provided herein, are shown to be connected to the facilities, <br />works or systems of, or are to be owned, managed and controlled <br />by, any public agency other than the City of Colton, or of any <br />public utility, it is the intention of this Council that the City <br />of Colton will enter into an agreement or agreements with the <br />public agency or public utility or both pursuant to Chapter 2 <br />(commencing with Section 10100) of Division 12 of the California <br />Streets and Highways Code, which agreement or agreements shall <br />provide for the ownership by said agency or utility of such <br />works, rights, improvements or acquisitions, and may provide for <br />the installation of all or a portion thereof by said agency or <br />-3- <br />9408000K.LA1 <br />
