NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the City Council of the City of Colton, County of San Bernardino, State of California, in regular session on April 5, 1994 as follows: 1. The foregoing recitals are true and correct and this Council so finds and determines. 2. Site Design Associates, Inc. is hereby appointed as Engineer of Work and is authorized to perform the engineering services enumerated in its written agreement, a copy of which is on file with the Clerk, in connection with the Assessment District and said firm shall be compensated for performing such services in accordance with the terms and conditions contained in said written agreement. The City Manager of the City is hereby authorized to execute said agreement on behalf of the City. 3. The proposed acquisitions and improvements are hereby referred to by the Engineer of Work, being a competent person employed by this County for that purpose, and said Engineer is hereby directed to make and file with the County Clerk a report, in writing, pursuant to Section 10204 of said Streets and Highways Code (herein, the "Engineer's Report"). 4. This City Council hereby accepts, approves and confirms the Preliminary Engineer's Report dated March 24, 1994 prepared by the Engineer of Work pursuant to and in accordance with Section 10204 of the Streets and Highways Code relating to the Assessment District. This City Council further directs the Engineer of Work to prepare and file with this City Council the final written report relating to the Assessment District. 5. It is the intention of this Council to order acquisition of the Improvements, as generally described in Exhibit "A" attached hereto and incorporated herein by reference, pursuant to the provisions of the Act. The description of Improvements contained herein is general in nature. The plans of the work, and maps and descriptions, as contained in the Engineer's Report, shall be controlling as to the correct and detailed description thereof. 6. It is the intention of this Council to form the Assessment District containing boundaries shown upon the plat or map attached hereto as Exhibit "B" and incorporated herein. 7. The City Council has received from the Redevelopment Agency for the City of Colton (the "Agency"), the sole landowner within the Assessment District, a Waiver of Cash Collection Period and Other Matters; hereby determines that said waiver, among other matters, meets the requirements for exception to the -2- 9408000K.LA1
