Failure to obtain final Council approval on a settlement agreement entered into on behalf of the City with Adams Advertising Company. 4. Failure on numerous occasions to effectively communicate with members of the City Council on a variety of important City matters. 5. General dissatisfaction with the manner in which Jerry Young has performed the duties of the position of City Manager, including without limitation, personnel promotion and assignment, attention to fiscal concerns of the City, and attendance on a daily basis to the necessary tasks involved with managing the City. SECTION 3. Based on the foregoing grounds and reasons, the City Council hereby notifies Jerry Young of its intention to terminate him as City Manager pursuant to the provisions of Section 2.16.020(B)(4), and further directs that this Resolution of Intention to Terminate the City Manager be served upon Jerry Young as required by law. SECTION 4. The City Council further orders and directs that a public hearing be set on May __,1994, a date at least 14 days after service of this Resolution of Intention to Terminate and no longer than 30 days from the date thereof, at which time Jerry Young shall be afforded the right to defend himself against the charges set forth herein. The decision to terminate or to retain Jerry Young in the position of City Manager shall be made by a majority vote of the City Council on a resolution which will be adopted at that public hearing or within five days thereof as provided by Section 2.16.020 of the Colton Municipal Code.
