R-54-94 <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF COLTON PURSUANT TO <br />SECTION 2.16.020 OF THE COLTON <br />MUNICIPAL CODE - RESOLUTION OF <br />INTENTION TO TERMINATE THE CITY <br />MANAGER <br />WHEREAS, on May 18, 1993 Jerry Young was appointed City Manager for the City of <br />Colton pursuant to Chapter 2.16 of the Colton Municipal Code; and <br />WHEREAS, on April 19, 1994, the City Council directed the City Attorney to prepare <br />this Resolution of Intention to Terminate the City Manager pursuant to the provisions of Section <br />2.16.020(4) of the Colton Municipal Code. <br />NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COLTON DOES <br />HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: <br />Section 1. It is the intention of the City Council to terminate Jerry Young as City <br />Manager in accord with the provisions of Section 2.16.020(B)(4) of the Colton Municipal Code <br />which state as follows: <br />"The city manager shall be appointed for an indefinite term and shall be <br />removable at the pleasure of at least a majority of the members of the city council <br />upon the adoption of a resolution so stating in the following manner: <br />(4) For any reason whatsoever by resolution adopted by the affirmative vote of <br />at least a majority of all members of the city council after a resolution of <br />intention to remove the city manager has been adopted by at least a majority of <br />the city council which resolution shall state the reasons or grounds for the <br />proposed removal.... " <br />Section 2. The stated reasons and grounds of the City Council for removal of Jerry <br />Young from the position of City Manager are as follows: <br />1. Failure to verify and report to the City Council regarding the status of <br />$500,000 established as a reserve fund in the budget adopted for fiscal <br />1993-94 despite repeated requests for such verification and report by <br />members of the City Council. <br />2. Failure to effectively oversee and direct the completion in a timely fashion <br />of the 1992-93 audit report being prepared by the City's accountants, <br />McGladry & Pullen. <br />
