City of Colton <br />Administrative Policy <br />SUBJECT: HARASSMENT POLICY STATEMENT <br />AND COMPLAINT PROCEDURE <br />I. PURPOSE <br />Number 4.04.030 <br />Date August 16, 1994 <br />Authority City Council <br />The Fair Employment and Housing Administration expressly prohibits <br />harassment of employees or applicants based on race, religious creed, <br />color, national origin, ancestry, physical handicap, political <br />affiliation, marital status, sex, age (over 40), and medical/physical <br />condition or disability or any other unlawful reason. <br />II. POLICY STATEMENT <br />It is the policy of the City of Colton to provide a work environment <br />free from unwelcome sexual overtures, advances and coercion. Employees <br />are expected to adhere to a standard of conduct that is respectful to <br />all persons within the work environment. The City will not tolerate any <br />form of harassment, nor will it tolerate any act of retaliation against <br />any person filing a complaint of harassment or hostile work environment. <br />III. POLICY AMPLIFICATION <br />Harassment is a violation of both Federal and State law. Harassment can <br />cause physical, emotional and economic problems for its victims. In <br />addition to the anxiety these demands may cause, there may be an <br />underlying message that noncompliance will lead to reprisals. These <br />reprisals can include escalation of the harassment, poor work <br />assignments, sabotaging work, unsatisfactory evaluations, threatened <br />demotions, transfer, poor job references, slander, gossip, blackmail, <br />and other forms of retribution. <br />Harassment undermines the integrity of the employment relationship. <br />Harassment can result in economic loss to both the City of Colton and <br />employee, in the form of excessive absenteeism and turnover, loss of <br />morale, polarization of staff and a decrease in management credibility, <br />and a decrease in productivity. <br />This Policy applies to all employees and to all applicants for City <br />employment. It is the responsibility of all City employees to adhere to <br />and implement this Policy. Failure to do so may result in disciplinary <br />action up to and including termination. <br />IV. DEFINITIONS <br />A. HARASSMENT <br />Harassment is defined as any behavior or conduct in the workplace <br />which results in a hostile work environment when such conduct or <br />behavior has the purpose or effect of unreasonably interfering with <br />an individual's work performance or creating an intimidating, <br />hostile, or offensive working environment ("hostile environment"). <br />No request for a sexual favor is necessary for hostile environment. <br />
