R-12-94 <br />2 A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF COLTON <br />3 (Section 21025, Government Code) <br />4 WHEREAS, the City of Colton (hereinafter referred. .to as <br />5 gency) is a contracting agency of the Public Employees' Retirement <br />6 System (PERS); and <br />7 WHEREAS, the Public Employees' Retirement Law (PERL) requires <br />8 that a contracting agency determine whether an employee of such <br />9 agency in employment in which he is classified as a local safety <br />10 member is disabled for purposes of PERL and whether such disability <br />11 is "industrial" within the meaning of such Law; and <br />12 WHEREAS, an application for disability retirement of George A. <br />13 Nunez, employed by the Agency in the position of Police Officer, <br />14 has been filed with PERS; and <br />15 WHEREAS, the City Council has reviewed the medical and other <br />16 evidence relevant to such alleged disability; <br />l% NOW, THEREFORE, BE IT RESOLVED; that the City Council find and <br />18 determine and it does hereby find and determine that George A. <br />19 Nunez is incapacitated within the meaning of PERL for performance <br />20 of his duties in the position of Police Officer and that the <br />21 primary disabling condition is Cardio -Vascular;_ and <br />22 BE IT FURTHER RESOLVED THAT THE City Council of the City of <br />23 Colton find and determine and it does hereby f ind and determine <br />24 that such disability is a result of injury or disease arising out <br />25 of and in the course of employment; and further determine that such <br />26 disability did not result from an injury which is the direct <br />27 consequence of a violent act perpetrated upon the -member and did <br />28 <br />
