Nunez, nor the City of Colton has applied to the <br />4 Workers' Compensation Appeals Board for a determination pursuant to <br />5 Section 21026 whether such disability is industrial; and <br />S BE IT FURTHER RESOLVED that the member will be separated from <br />7 his employment in the position of Police Officer after expiration <br />g of his leave rights under Section 21025.4, Government Code, <br />9 effective February 2, 1994, and that no dispute as to the <br />10 expiration of such leave rights is pending; and <br />11 BE IT FURTHER RESOLVED that there is not a pos ibi,lity of a <br />12 third party liability; and <br />13 BE IT FURTHER RESOLVED that Advanced Disability Pension <br />14 payments will be made. The payments will be made monthly in the <br />15 amount of $1,800.00 beginning March 1,.1994. The first Advanced <br />16 Disability Pension payment will be in the amount of $1,598.00. PERS <br />17 reimbursement for these advanced disability payments shall be sent <br />18 to: City of Colton <br />Personnel Department <br />19 .650 N.
