May 10, 1994 <br />The Honorable Mayor and <br />Members of City Council <br />City of Colton <br />650 N. La Cadena Dr. <br />Colton, CA 92324 <br />RE: Civil Service Board - Findings and Recommendations in the <br />matter of the Herron v. Colton appeal. <br />The Honorable Mayor and Members of City Council: <br />Kenneth Herron (hereinafter "Herron") appealed his termination of <br />his employment with the City. The issue that was heard on appeal <br />is whether Herron was on probation at the time of his termination <br />from the City. <br />The Civil Service Board convened the hearing on this matter on <br />February 16, 1994, in accordance with Resolution Number 2240, which <br />sets forth the Personnel Rules and Regulations for the City of <br />Colton, Rules III, XV and Municipal Ordinance Number 1122, Section <br />5. The hearing took place over six days as follows: <br />February 16, 1994 <br />February 25, 1994 <br />February 28, 1994 <br />March 10, 1994 <br />April 14, 1994 <br />April 21, 1994 <br />FINDINGS <br />The majority of the Civil Service Board, after having received the <br />evidence presented by the parties in this matter, find that Herron <br />had passed probation and was a regular employee on the date of his <br />termination, based upon official City documentation (Exhibits 2, 6 <br />and 11) . <br />RECOMMENDATIONS <br />The Civil Service Board further recommends to the City Council the <br />following: <br />1. Revise the City Manager Ordinance 2.16.020 to clarify the <br />powers of the City Manager after the City Council has <br />1 <br />
