a t CITY OF COLTON AGENDA REPORT (CONTINUED) FOR COUNCIL MEETING OF MARCH 1, 1994 SUBJECT: Public Hearing of File Index Number DO -04-94, an amendment to Chapter 18.56 of the Colton Municipal Code (Zoning Ordinance) Relating to Property Maintenance As presented, any property owner who maintains any nuisance as defined in the proposed amendment and who fails to comply with the Order of Abatement will be guilty of an infraction. Any person who removes any notice of order posted, as required by this amendment, for the purpose of interfering with the enforcement of the provisions of this proposed Chapter will also be guilty of an infraction. Lastly, any person who obstructs, impedes or interferes with any representative of the City, including persons who own, lease, or occupy property, when any of the aforementioned individuals are lawfully engaged in proceedings involving the abatement of a nuisance under this proposed Chapter, is guilty of an infraction. ENVIRONMENTAL DETERMINATION Section 15061, Subsection (b) (3) of the.California Environmental Quality Act (CEQA) Guidelines provides that, where an agency can determine, with certainty, that no possibility exists that a project may produce significant environmental effects, the agency has no further obligations under the California Environmental Quality Act. Based on this, staff finds the proposed amendment "exempt". FINANCIAL IMPACT: Staff anticipates no financial impact to the City as a result of the proposed amendment.
