H;�u, Collins, and Drew <br />April 21, 1994 <br />Page 2 <br />The issues and the resolution as provided for in the <br />1994 Set�tlement Agreement are as follows: <br />1) Intec�ration of City Replaceable Resources <br />Pursuant to the 1990 Settlement Agreement, each <br />City had a one-time right to replace those Special <br />Condition 12 resources that had been integrated as <br />part of the 1990 Settlement. A dispute had arisen <br />with Edison over how to implement that right. <br />Section 5.1.1 of the 1994 Settlement Agreement <br />provides that a City must give a minimum of six <br />months' notice prior to the date of integration of <br />the new resource, but no later than three years <br />after the contract for the original resource <br />terminates. The 1994 Settlement also provides each <br />City with flexibility as to the level of capacity <br />credit for the Replaceable Resource. Furthermore, <br />a City may replace the resource with one or more <br />new resources with varying operation dates. <br />2) Preschedulinq of Interruptible Transmission Service <br />Section 5.1.2 of the 1994 Settlement Agreement <br />provides that Edison will meet with Cities and <br />others to attempt to negotiate terms and conditions <br />for prescheduled ITS. If the parties cannot agree <br />on such service by July l, 1994, then Edison agrees <br />to provide the service using ITS under the Western <br />Systems Power Pool Agreement (WSPP) for a period of <br />two years. During that two-year period, Edison and <br />Cities agree to use mediation to resolve the issue. <br />3) Sugplemental Non-Firm Enerqy Aqreements <br />Section 5.1.3 of the 1994 Settlement provides a <br />procedure to expedite integration and FERC filing <br />of these agreements. <br />4) STS Schedulinq Practices <br />Section 5.1.4 provides a procedure for resolving a <br />dispute between Anaheim/Riverside and Edison over <br />the scheduling of energy over the STS. <br />5) Correction of Resource Accountinc� Schedule Errors <br />Section 5.1.5 provides for a 180-day period for any <br />party of correct ministerial or typographical <br />errors in a Resource Accounting Schedule and revise <br />billing. <br />
