Lavin, Water Utilities Manager 11t <br />SUBJECT: Date <br />Approval of Amendment to Lease Agreement <br />with Beckett <br />BACKGROUND: <br />On July 1, 1993 the Santa Ana Watershed Project Authority (SAWPA) , on behalf <br />of the Cities of Colton and San Bernardino, entered into a lease agreement with <br />James and Francis Beckett for property SAWPA purchased from the Becketts as <br />additional land for future expansion of the RIX project. The property has yet to be <br />incorporated into the design of the project, as it will be used for capacity expansion <br />when needed. The Becketts desire to continue using the land and, therefore, the <br />lease agreement was entered into. <br />DISCUSSION: <br />The new terms are as follows: 1. Execute an amendment to the lease agreement <br />being month-to-month with rent at $1,000/mo. 2. Becketts to immediately pay <br />$12,000 of the outstanding $28,188.93. 3. Execute a promissory note in the <br />amount of $16,188.93 payable at $1,000/mo. The additional payment of $7,000 <br />will occur when SAWPA credits Beckett the estimated $7,000 value for an <br />easement at the north side of their property. Beckett has paid the $5,000 and <br />SAWPA expects the easement transaction to occur within the next few months. <br />FINANCIAL IMPACT: <br />No financial impact, the lease agreement is revenue to the Wastewater fund. <br />RECOMMENDATION: <br />Staff recommends that Council approve the Amendment to the Lease Agreement <br />with Beckett. <br />LJ/fj <br />CITY MANAGER'S CONCURRENCE: <br />Attachments: <br />Page 1 of_—_ Item No. 6 <br />
