t FIRST AMENDMENT TO RENTAL. AGREEMENT DATED JULY 1, 1993 THIS FIRST AMENDMENT TO RENTAL AGREEMENT DATED JULY 1, 1993 (hereafter "FIRST AMENDMENT") is made and effective this first day of July 1994 by and between JAMES BECKETT and FRANCIS BECKETT, husband and wife (hereafter "BECKETT"), and the SANTA ANA WATERSHED PROJECT AUTHORITY (hereafter "SAWPA"), a public agency. RECITALS A. On July 1, 13093, S.",:"rlPA and BECKET.T' entered Into that certain Renta! Agreement, of which a true and correct copy is attached hereto as Exhibit A, and made a part hereof. B. During the period of July 1, 1993 through June 30, 1994, BECKETT failed to pay all of the rent due thereunder, and on July 16, 1994, SAWPA served BECKETT with a "Three -Day Notice to Pay Rent or Quit", dated July 15, 1994, of which a true and correct copy Is attached hereto as Exhibit B, and made a part hereof. C. In response to the said Three -Day Notice, BECKETT offered to cure the default. Atter negotiation, SAWPA agreed to continue renting the subject property to BECKETT, pursuant to the terms and conditions set forth in the Rental Agreement, as modified by this First Amendment. NOW THEREFORE, in consideration of the foregoing facts and the mutual covenants of the parties, SAWPA and BECKETT hereby agree as follows: AGREEMENT 1. Incorporation of Recitals. The foregoing Recitals are true and correct and are incorporated herein by this reference as though set forth in full. 2. Termination. Paragraph 4 of the Rental Agreement, entitled "Termination", Is hereby amended in its entirety and shall hereafter read as follows: "4. Termination. SAWPA shall have the right to terminate the AGREEMENT at any time upon 30 -days' notice, and BECKETT shall have the right to terminate the AGREEMENT on Parcels B-2 or B-3 upon 30 -days' notice, or may terminate the AGREEMENT on Parcel B-1 on 30 days' notice, and the rental of Parcels B-2 and B-3 shall be concurrently terminated automatically, without further notice."
