Fiscal Effect: <br />None. Under the proposed revisions to administrative policy, employees will continue <br />to receive normal pay when they attend employment related administrative hearings and when <br />they are subpoenaed to appear in their official capacity. Non-exempt employees, however, will <br />be entitled to overtime pay at the expense of the individual issuing the subpoena if they are <br />required to appear as witnesses on days when they are not on duty. The effect will only be to <br />institute a procedure to assure that the party issuing the subpoena is charged for the actual cost <br />to the City of making the employee available to testify. <br />Conclusion <br />Staff recommends adoption of the attached proposed Resolution establishing the <br />administrative policy with regard to compensation of City employees while acting as witnesses <br />under subpoena. In addition, Staff recommends amending the existing policy (4.05. 110) to <br />delete references there to compensation issues having to do with subpoenas and leaving in place <br />the policy regarding leave for appearance and employment related administrative hearings. <br />These really are two separate issues that need separate policy statements. <br />k_,iry manager <br />
