R-116-94 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF COLTON ADDING ADMINISTRATIVE POLICY 4.05.440 <br />REGARDING PAYMENT OF OVERTIME FOR NON- <br />EXEMPT EMPLOYEES UNDER SUBPOENA AND <br />PAYMENT OF WITNESS FEES TO EXEMPT EMPLOYEES <br />PURSUANT TO THE PROVISIONS OF THE CALIFORNIA <br />GOVERNMENT CODE <br />WHEREAS, City employees are sometimes subpoenaed to testify in matters relating to <br />the duties of the position that they hold within the City; and <br />WHEREAS, Government Code Section 68096.1 requires the City to compensate City <br />employees for the salary and expenses incurred in order to comply with such subpoenas; and <br />WHEREAS, Government Code Section 68096.1 also provides that the City shall be <br />reimbursed by the party issuing a subpoena for the cost of the salary and expenses provided to <br />City employees while under subpoena; and <br />and <br />WHEREAS, subpoenas may be issued for times when City employees are not on duty; <br />WHEREAS, when City employees are subpoenaed in their official capacity while not <br />on duty, all such employees who are not exempt from overtime payment are entitled to payment <br />of overtime; and <br />WHEREAS, Government Code Section 68093 provides that any individual who is <br />subpoenaed is entitled to payment of a witness fee of $35.00 together with any necessary travel <br />expenses; and <br />WHEREAS, City employees who are exempt from overtime payment and therefore <br />exempt from the provisions of Government Code Section 68096.1 to the extent that they are <br />subpoenaed to appear at times when they are not on duty should nevertheless be entitled to <br />
