Joe Stell advised that on this day he had regretfully filed a lawsuit against the City of <br />Colton, mainly to get this matter going and underway. <br />Mr. Stell then reviewed, for Council's information, the expansion project at the Water Quality <br />Control Plant, and the incidents that took place up to the present time. <br />Mr. Stell advised that many things brought about problems for the contractor, such as ommissions <br />in the plans and specifications, problems with the on-site engineer, lack of communication, and <br />too many delays. <br />Mr. Stell said in order to expedite this matter and resolve it to everyones benefit, they are <br />requesting two things: <br />1. That the City Council will recommend approval of releasing and paying to the contractor the <br />amount of $40,000 to $50,000, the amount being held as a penalty assessment. <br />2. That the City Council proceed with the setting up of an Arbitration to resolve this dispute. <br />Mayor Huntoon thanked Mr. Stell for his presentation and advised that anything the City might <br />do would be under the direct advise of our City Attorney, and that he would be handling this <br />matter. <br />Ordinance No. 1463. <br />Assistant City Attorney Edwards introduced the following ordinance for first reading, reading <br />it as to number and title only: <br />ORDINANCE NO. 1463 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON, PROVIDING FOR <br />THE LEVY AND COLLECTION OF TAXES FOR MUNICIPAL USES TO BE LEVIED- AND <br />COLLECTED BY THE COUNTY OF SAN BERNARDINO. <br />On motion of Councilman Rehrer, seconded by Councilwoman Spragins and unanimously passed, first <br />reading of Ordinance No. 1463 was approved, and further reading waived. <br />Ordinance No. 1464. <br />Assistant City Attorney Edwards introduced the following ordinance for first reading, reading <br />it as to number and title only: <br />ORDINANCE NO. 1464 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON FIXING'THE AMOUNT <br />NECESSARY TO BE RAISED BY TAXATION TO CARRY ON THE VARIOUS DEPARTMENTS OF <br />THE CITY OF COLTON FOR THE CURRENT YEAR OF 1974-75. <br />On motion of Councilman Rehrer, seconded by Councilwoman Spragins and unanimously passed, first <br />reading of Ordinance No. 1464 was approved and further reading waived. <br />Ordinance No. 1465. <br />Assistant City Attorney Edwards introduced the following ordinance for first reading, reading <br />it as to number and title only: <br />ORDINANCE NO. 1465 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON, FIXING THE 1974-75 <br />TAX RATE FOR THE CITY OF COLTON. <br />On motion of Councilman Rehrer, seconded by Councilman Hayes and unanimously passed, first <br />reading of Ordinance No. 1465 was approved, and further reading waived. <br />Claim: Dorothy L. Cullum versus the City of Colton. <br />Assistant City Attorney Edwards stated the Claim involves an alleged power failure by a Mrs. <br />Dorothy L. Cullum, and after investigation, our insurance carrier recommends rejection of the <br />claim. <br />On motion of Councilman Rehrer, seconded by Councilman Gonzales and unanimously passed, the <br />City Council rejected the Claim of Mrs. Dorothy L. Cullum. <br />Claim: Dolores Salazar versus the City of Colton. <br />Assistant City Attorney Edwards stated with regard to the Claim of Mrs. Dolores Salazar, it <br />is recommended this claim be rejected by the City and referred to the insurance carrier. <br />On motion of Councilman Rehrer, seconded by Councilman Hayes and unanimously passed, the Claim <br />of Mrs. Dolores Salazar was rejected by the City Council. <br />EXECUTT VE SER S Tnw <br />The City Council adjourned to Executive Session at 8:12 p.m., on the request of Mayor Huntoon. <br />The City Council reconvened at 8:34 p. m., all members present. <br />Planning Commission Appointment: <br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed, Mr. <br />Curt Roach was appointed to the Planning Commission to fill the unexpired term of Mr. Roy <br />Martin. <br />AUG 2 0 1974 <br />
