Mr. Wilhite spoke again, stating there is only one tractor manufactured that will meet the
<br />specifications issued by the City of Colton. Mr. Wilhite said to require a manufacturer to
<br />meet the specifications of another vendor's piece of equipment is not really in the context
<br />of competitive bidding, and specifications should not be written so tight that only one
<br />manufacturer -'s machine can, in fact, meet the specifications.
<br />Mr. Wilhite added the bucket on their machine does return to dig to a level position, which
<br />is done through a mechanical linkage and by pushing a lever forward by the operator.
<br />Mr. Tom Banner, representing Eagle Tractor, Inc., stated the City of Colton presently owns
<br />Case equipment, Case 530, and the buckets on these machines would be interchangeable with
<br />the new equipment, and the City employees that operate this equipment are familiar with the
<br />Case machines.
<br />Mr. Banner said as far as the bid prices are concerned, there is no actual evidence in the
<br />way that Whitney Tractor submitted their bid as to whether or not the optional equipment
<br />was included, this was merely a verbal statement. Mr. Banner stated he questions the legal-
<br />ity of this form of procedure.
<br />On motion of Councilwoman Spragins, seconded by Councilman Gonzales and unanimously passed,
<br />Council approved awarding the bid for diesel engine whell tractor with hydraulic operating
<br />front end loader and hydraulic backhoe to Eagle Tractor, Inc., of Riverside in the amount -
<br />$142475.
<br />Trenching Machine.
<br />Mr. Young reported that Staff received and opened bids for a trenching machine on September
<br />10, 1974, one bid from Ditch Witch Trenching Company, Inc., in the amount of $5,623.30,, and
<br />one from Eagle Tractor, Inc�,in the amount of $5,824.70.
<br />Mr. Young continued that Ditch Witch Trenching Company indicated the floatation tires as
<br />optional equipment and added $160 to the cost. This item was to be included'in the net
<br />price as called for in the specifications. The specifications ask for an optional bid of a
<br />moving trailer, however, Ditch Witch has included this in their net price. Mr. Young said
<br />the Council members have copies of a letter submitted by Ditch Witch entitled "Exceptions to
<br />Bid Conditions and Specifications".
<br />Mr. Young stated the bid submitted by Eagle Tractor, Inc., appears to conform to the conditions
<br />of the specifications.
<br />Mr. Young concluded that Staff recommends awarding the bid to Eagle Tractor, Inc., in the
<br />amount of $5,824.70.
<br />On motion of Councilman Gonzales, seconded by Councilwoman Spragins and unanimously passed,
<br />Council approved -awarding the bid for the trenching machine to Eagle Tractor, Inc., in the
<br />amount of $5,824.70.
<br />Award Bid for 3/4 Ton Pickup.
<br />Mr. Young advised that Staff received and opened bids September 12, 1974, for a 3/4 ton pick-
<br />up for the Street Division.
<br />Mr. Young stated that two bids were received for this equipment, one from Moss Motors in
<br />the amount of $5,203.53, and the other from Center Chevrolet in the amount of $5,415.95.
<br />Mr. Young concluded Staff recommends awarding the bid to Moss Motors in the amount of $5,203.53.
<br />Councilman Rehrer asked how much equipment does the City presently have that is either General
<br />Motors or Dodge.
<br />Mr. Young answered the greatest amount of the City's large equipment is International, and
<br />most of the City's older equipment is General Motors. Mr. Young stated some of the newer
<br />equipment that has been coming in, and several of the City's dump trucks, are from Dodge.
<br />Mr. Joe Lopez, 789 West F Street, Colton, stated he would like to know what kind of equipment
<br />this pickup truck has on it to cost over $5,000, and what will it be used for.
<br />Mr. Young answered this piece of equipment will be used by the Street Division as the paint-
<br />ing and striping truck, it will contain a utility body and be used to carry signs and paint
<br />equipment, and will have the heavy duty springs.
<br />On motion of Councilwoman Spragins, seconded by Councilman Hayes and unanimously passed,
<br />Council approved awarding the bid for the 3/4 ton pickup truck to Moss Motors in the amount
<br />of $5,203.53.

<br />Parking Problems - West "F" Street.
<br />City Manager Huffaker stated Council members have copies of a memorandum from the Acting
<br />Police: Chief regarding the parking problems along West F Street, which he read as follows:
<br />On September 16, 1974, this department received several complaints regarding enforcement of
<br />parking ordinancnes on "F" Street between Rancho Avenue and 3rd Street (600 - 700 block).
