<br />City Attorney Edwards introduced Ordinance No. 1501 for first reading, advising that this ordinance adopts the
<br />Uniform Plumbing Code, 1976 Edition.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to approve first reading of Ordinance No. 1501.
<br />Vote was unanimous.

<br />ING THE INSTALLATION OF PLUMBING WITHIN THE CITY OF COLTON.

<br />Mill Street Overpass
<br />Mr. Edwards read his memorandum dated August 12, 1976, regarding a small parcel of land located in the City of
<br />Colton, which the City of San Bernardino wishes to acquire in connection with the development of the Mill
<br />Street Overpass.
<br />Mr. Edwards advised this land will be deeded to the City of Colton, and the City of San Bernardino will pay
<br />the costs involved for this transaction.
<br />Mr. Edwards concluded it would be in order for the Mayor and City Clerk to execute the escrow instructions on
<br />behalf of the City of Colton.
<br />Councilman Rehrer asked if there will also be other parcels of land involved in similar transactions that are
<br />located in the City of Colton.
<br />Mr. Lewis E. Little, Real Property Engineer of the City of San Bernardino, answered yes, there are other
<br />parcels of land involved that are within the City of Colton, however, these will be handled in the same manner,
<br />the land will be deeded to the City of Colton, and the City of San Bernardino will pay all costs involved.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, authorizing Mayor and City Clerk to execute
<br />Escrow Instructions with regard to the Mill Street Overpass. Vote was unanimous.
<br />Elections
<br />City Attorney Edwards introduced Resolution Nos. 3633 and 3634, which pertain to the forthcoming Special
<br />Municipal Election to be held in the City of Colton and consolidated with the Statewide General Election,
<br />November 2, 1976, concerning an amendment to the City's Employees' Retirement Plan for safety members of the
<br />Police and Fire Department, and also amends Resolution Nos. 3629 and 3630.
<br />Mr. Edwards explained that these Resolutions now contain the corrected amendment, or measure, and proposed
<br />Ordinance, to be considered by the qualified voters of the City on the November ballot.
<br />Mr. Edwards stated that City Clerk Ramos may be able to clarify any questions the Council members may have on
<br />this matter.
<br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to approve Resolution No. 3633 and Resolution
<br />No. 3634. Vote was unanimous.

<br />BER 2, 19765 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS
<br />OF SAID CITY AN ORDINANCE RELATING TO AMENDING THE CITY OF COLTON'S
<br />EMPLOYEES' RETIREMENT PLAN AND CONSOLIDATING SAID ELECTION WITH
<br />THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE.

<br />3634 - A RESOLUTION OF THE CITY OF COLTON, CALIFORNIA, AMENDING,RESOLU-
<br />TION NO. 36309 REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY
<br />OF SAN BERNARDINO TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION OF
<br />THE CITY OF COLTON TO BE HELD ON NOVEMBER 2, 1976, WITH THE STATE-
<br />WIDE GENERAL ELECTION TO BE HELD ON NOVEMBER 2, 1976, PURSUANT TO
<br />SECTION 23302 OF THE ELECTIONS CODE.
<br />ORAL COMMUNICATIONS:
<br />Mr. Frank Smith, 270 West F Street, Colton, stated he had several items he would like to bring to the Council's
<br />attention.
<br />Mr. Smith stated first of all, the railroad is still leaving their trains standing in the residential areas,
<br />which creates a great deal of noise and disturbance for the residents. Secondly, with regard to weed abatement,
<br />Mr. Smith felt the City should also get after the railroad companies for not cleaning and maintaining the
<br />frontage of their properties.
<br />Mayor Beltran advised Mr. Smith that he had written a letter to the railroad companies, advising them of the
<br />problem they were creating in our residential districts by leaving their trains unattended, and requested that
<br />they be moved to their own storage yards. Mayor Beltran stated that to date he has not had a reply from the
<br />railroad.
<br />Mayor Beltran further stated that he agrees with Mr. Smith, as far as the frontage of the railroad properties
<br />and the poor maintenance.
<br />Councilman Hayes suggested that the Interstate Commerce Commission and the Public Utilities Commission be
<br />notified of the problems our City has encountered with the railroads, as both of these entities have jurisdic-
<br />tion over the railroads.
<br />Mayor Beltran stated that if there are no objections from the other Council members, he will again write a
<br />letter to the railroad company, apprising them of these problems discussed this evening, and will also notify
<br />the Interstate Commerce Commission and the Public Utilities Commission at the same time.
<br />Mr. Smith said he also wanted to complain again about the air pollution and odor coming from the Kelley Hal Grain
<br />and Milling, Inc., and felt the Council should definitely do something about all of these obnoxious odors
<br />being created in the City.
<br />Moved by Councilman Gonzales, seconded by Councilwoman Cisneros, that the City file an official complaint with
<br />the Air Pollution Control District regarding air pollution and odor nuisance created by certain companies in
<br />the City of Colton. Vote was unanimous.
