Task Schedule

<br />Mr. de la Cerda also requested approval and adoption of the Task Schedule for the Housing and Community Development
<br />Program, copies of which were previously given to Council members and discussed at the Adjourned Regular
<br />Meeting held November 10, 1976.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, to approve and adopt Task Schedule for the
<br />Housing and Community Development Program as submitted by Mr. de la Cerda. Vote was unanimous.
<br />National Guard
<br />A presentation was made to the City Council by Col. George Gunner and Capt. John Bernantz, of the California
<br />National Guard, advising there is now a Colton Guard Troop located at 423 East B Street, with troops available
<br />for the aid, assistance and many other services to the City of Colton.

<br />Mayor Beltran declared the Public Hearing open.
<br />Personnel Officer Huffaker submitted the Affidavit of Posting and reported that no protests or objections had
<br />been received.
<br />Mr. Huffaker reported from his memorandum regarding consideration and approval of first reading of an ordinance
<br />to amend Civil Service System Codes relating to ineligibility for employment for criminal conduct, which would
<br />bring the City into compliance with recently adopted state legislation.
<br />Mr. Huffaker continued that cities have considered the criminal history of applicants obtained as part of
<br />background checks in making decisions on hiring, and state law now requires the City Council, by ordinance,
<br />specify to whom this information may be released and for what reasons.
<br />Mr. Huffaker advised that the League of California Cities has a model ordinance, drafted by a select committee of
<br />city attorneys, and the Cities of Orange and Santa Ana have adopted this same ordinance.
<br />Mr. Huffaker concluded if Council concurs, Staff recommends that first reading of the proposed ordinance be passed.
<br />Additional comments and report were made by City Manager Huffaker and Police Chief Elliott on this matter.
<br />Councilman Hayes suggested an addition to the proposed ordinance, on Page 1, line 15.
<br />Speaking in opposition to the proposed ordinance and this issue were Councilman Gonzales, Mrs. Pauline Garcia, and
<br />Mrs. Frances Grice. Mr. E. H. Robinson also made comments on this issue.
<br />Mayor Beltran read two letters from Mr. James R. Cooper, Employee Representative of the San Bernardino Public
<br />Employees Association, one addressed to the Mayor and Council Members_, the other addressed to Mr. Sol Pavlosky of
<br />the Equal Employment Opportunity Council, indicating opposition to this issue and the proposed ordinance.
<br />After additional discussion, moved by Councilman Gonzales, seconded by Councilwoman Cisneros, to deny Ordinance No.
<br />1505. Vote was unanimous.
<br />CORRESPONDENCE:
<br />Bicentennial Committee
<br />City Manager Huffaker read a memorandum from Councilman Rehrer regarding the purchase of a locking horizontal table
<br />case for the City Hall foyer, to be used as a display case by the Bicentennial Committee, and other members and
<br />affiliates. The case can be purchased at a cost of $500, from the Bicentennial Committee budget.
<br />Moved by Councilman Hayes, seconded by Councilman Gonzales, approving purchase of locking horizontal table case, in
<br />the amount of $500, by the Bicentennial Committee, for the City Hall foyer. Vote was unanimous.
<br />Weed Abatement
<br />Mr. Huffaker reported on a letter received from Mr. Ricardo Bustamante, dated November 8, 1976, regarding weed
<br />abatement charges on Parcel 161-251-10, at the address of 975 North 12th Street, Colton.
<br />The letter advised that Mr. Bustamante had purchased this property in February of 1975, and the amount for these
<br />charges, of $233.93, had appeared on his 1976 tax bill as a lien against the property, for work that had been done
<br />for the previous owner in 1974, but never collected.
<br />Mr. Huffaker stated that the Finance Department had made many attempts to contact the previous owner for payment of
<br />these weed abatement charges, but had been unsuccessful.
<br />Mr. Bustamante then addressed the City Council, stating he felt this charge was unfair and that he should not be
<br />held responsible for it, and also asked why the City waited until 1976 to place a lien against the property for the
<br />charges they should have collected from the previous owner two years before.
<br />City Attorney Edwards explained this weed abatement work was done in October of 1974, and Mr. Bustamante purchased
<br />this property in February of 1975. The Real Property Tax Bills are issued once a year, in November, which would
<br />have been too close a proximity for this charge to appear on the 1974 tax bill. Mr. Edwards continued that in the
<br />interim, the City attempted to collect this charge from the previous owner, therefor, the charge, again, did not
<br />appear on the 1975 tax bill and, in this delay, this charge did not appear as a lien against the property until the
<br />1976 tax bill.
<br />Council Members felt, at any rate, this charge is the responsibility of the previous owner, additional steps should
<br />be taken to collect from him, and Mr. Bustamante should not be liable for this charge.
<br />Moved by Councilwoman Cisneros, seconded by Councilman Gonzales, to relieve Mr. Bustamante of the 1974 Weed Abate-
<br />ment charges in the amount of $233.93, and the City take additional steps to collect this outstanding charge from
<br />the previous owner. Unanimous vote.
