Councilwoman Cisneros asked if staff had a recommendation on the time element for construction. <br />Mr. Williams replied that he felt permit and construction should be commenced in thirty days. <br />Councilman Rehrer asked Mr. Williams if any construction plans have been drawn yet. <br />Mr. Williams replied that he is not aware of any. <br />347 <br />Mr. Walter Shultz of Empire Plating, reported the company is in the process of having the building plans drawn, <br />that they have cleared and oiled their adjacent lot and are in the process of constructing fencing around this lot <br />which will be used for off street parking for their employees. Mr. Shultz said the company anticipates that they <br />will be able to secure a building permit in two weeks and that construction of the building will be completed in <br />90 days, however, as stated in their letter they are requesting a 3 - 5 year waiver for construction of the curb, <br />gutter, sidewalks, and off street parking. <br />Mr. Alan Gathercoal, 108 Pleasantview, stated that he had submitted a petition in regards to the noise four months <br />ago and was disturbed with the slow process and seemingly lack of progress with resolving the noise problem. <br />Discussion followed..on the status of the problem and solution thereof. <br />Moved by Councilman Hayes, seconded by Councilman Rehrer, to grant Empire Plating Company a thirty day period in which <br />to commence construction, to grant a waiver of off-site improvements conditioned upon the execution of a recordable <br />agreement defining terms of waiver. Unanimous vote. <br />Niiicanrin <br />Odor - Engineered Fiberglass, Inc. <br />Planning Director Williams reported from his memorandum to the City Council saying that he had made a field inspection <br />of Engineered Fiberglass, with Mr. Myers of the company. Mr. Williams also reported that OSHA and the State Health <br />Department have made recent visits to the company and report no problems or health hazards. <br />Mr. Williams continued that the odor is quite obvious inside and outside the plant facility, as well as being strong <br />for about one block to the north and east in the adjoining residential area. <br />Mr. Myers addressed the Council saying he is concerned about the odor problem and indicated a desire to continue work- <br />ing on the problem because the company does not want the neighbors to be annoyed with the odor. Mr. Myers said he <br />knows the odor is not harmful health -wise. <br />Planning Director Williams stated the only comment he would add is that if it is the Council's desire to initiate <br />procedures to abate the company as a public nuisance, then Staff should be directed to gather information on the <br />problem by logging telephone calls received by the City and in turn notifying the APCD. Mr. Williams said this is the <br />same procedure suggested and followed by the then City Attorney when the City encountered a similar problem with <br />Marco Chemical. <br />Discussion followed. <br />Mr. Henry Martinez, 191 South 3rd Street, Colton, reported some improvement in the odor problem has been noted, how- <br />ever, there is definitely room for further improvement. In addition, Mr. Martinez, said the company needs to do <br />something about the landscaping on the north and east sides of the plant. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to instruct Staff to proceed in gathering information <br />for abatement of Engineered Fiberglass, Inc. as a public nuisance. Unanimous vote. <br />Annexations <br />Colton Joint Unified School District <br />Planning Director Williams reported that the Colton School District is requesting that the City initiate an annexa- <br />tion of a 10 -acre parcel of land on the south side of Washington Street and behind the 7-11 store and Racketball <br />Club. <br />Mr. Williams explained that there are several annexation fees involved and Council must decide whether the City or <br />the School District will incur these costs, totalling between $300 and $00. <br />Mr. Williams concluded by saying the letter from the School District stipulates the annexation request is conditioned <br />on pre -zoning of the property to R-3. <br />Discussion followed. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to approve the annexation request of the Colton <br />Joint Unified School District conditioned on the School District paying all related annexation fees. Motion <br />carried. Councilman Hayes abstaining. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />GOVERNMENTAL AGENCIES <br />Department of Water Resources - Permit <br />Community Services Director Young reported from his memorandum dated September 3, 1976 relating to a requirement <br />for a construction permit from the Department of Water Resources. <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, to approve Resolution No. 3636. Unanimous vote. <br />RESOLUTION NO. 3636 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON <br />CALIFORNIA, AUTHORIZING THE MAYOR TO SIGN ACCEPTANCE <br />OF SANITARY SEWER ENCROACHMENT PERMIT FROM DEPARTMENT <br />OF WATER RESOURCES. <br />TRAFFIC <br />Regulations & Control - Agua Mansa <br />Community Services Director Young reported from his memorandum dated September 3, 1976, entitled Speed Zone Study - <br />Agua Mansa Road. <br />Discussion followed. <br />Moved by Councilman Hayes to post the southern portion of Agua Mansa at 45 miles per hour. <br />Mr. Young cautioned the City Council stating that if it Council's desire to to post the south side at 45 miles per <br />hour, that Staff be instructed to make further studies to determine if in fact the sharp curved areas of Agua Mansa <br />can be safely driven at 45 miles per hour and/or what would be the safe speed at the curved areas. <br />
