42-1 <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Water Quality Control <br />Community Services Director Earl Young requested that the item concerning regulating discharge of waste into <br />the sewage system be continued to the next regular Council Meeting. <br />Streets <br />Orange Show Road Alignment <br />Mr. Robert Moody, Manager of Inland Golf Center in Colton, made a presentation to the City Council with regard <br />to the proposed realignment of Orange Show Road, indicating on drawings and maps the area involved in the <br />realignment, intersecting with Fairway Drive. <br />Councilman Rehrer felt there would be a problem with the flow of traffic with the proposed realignment as <br />presented, and recommended this matter be referred back to Staff for further study. <br />After additional discussion, moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to refer back to Staff <br />the proposed realignment of Orange Show Road for additional study and report. Vote was unanimous. <br />Assessment District No. 1976-1 (Cooley Drive) <br />Mr. Young advised that Staff is requesting approval of a resolution ordering work to be executed and performed by <br />City forces in the assessment district, which involves the Electric Department and Community Services Department. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, approving Resolution No. 3676. Vote was unanimous. <br />RESOLUTION NO. 3676 - RESOLUTION OF THE CITY COUNCIL ORDERING WORK TO BE EXECUTED AND <br />PERFORMED BY CITY FORCES IN A SPECIAL ASSESSMENT DISTRICT. <br />Mayor Beltran announced the City Council will take a 15 minute recess. <br />CITY MANAGER'S REPORTS AND RECOMMENDATIONS: <br />Impasse Hearing <br />San Bernardino Public Employees Association <br />Mayor Beltran declared the hearing open. <br />Acting City Manager Johnsen made the Staff presentation, reading a memorandum dated April 5, 1977, regarding repre- <br />sentation of General Employees Unit by a recognized employee organization, as outlined in the Rules and Regulations <br />of Resolution No. 2996. <br />Mr. Johnsen continued that the San Bernardino Public Employees Association is challenging a determination made by <br />the Municipal Employee Relations Officer, that SBPEA no longer represents employees of the previous unit, and <br />further, that they are required Ito submit a petition with signatures for formal representation in order to appear <br />on the ballot for the modified General Employees Unit. <br />Mr. Richard C. Stearns, General Manager of the San Bernardino Public Employees Association, gave a presentation on <br />the history of the Association and its representation of City employees over the past six years, stating the Associa- <br />tion is opposing the decertification of their organization as representatives of the employees of the City when <br />they, in fact, have been in Colton for over six years and are still representing the majority of City employees. <br />Discussion followed among Council Members, Staff and Association Members. <br />The City Council adjourned to Executive Session at 10:15 p. m., on the request of Councilwoman Cisneros, to discuss <br />Personnel Matters, and reconvened at 10:45 p. m., all Members present. <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to terminate the hearing. Vote was unanimous. <br />Moved by Councilman Rehrer, seconded by Mayor Beltran, to table a decision on this matter until the next regular <br />Council Meeting, when a full quorum will be present, and extend the date of the election. Vote was unanimous. <br />Personnel <br />Disability Retirement <br />Moved by Councilman Rehrer, seconded by Councilwoman Cisneros, to approve <br />Resolution No. 3677, with a correction to Line 18, making the effective <br />date March 28, 1977. Davenport, Harry Davenport <br />and William Davenport versus the City of Colton, as recommended by insurance administrator. Vote was unanimous. <br />Legislation <br />Recreational Bond Act of 1976 <br />Acting City Manager Johnsen read his memorandum dated April 5, 1977, regarding consideration of the County -wide per <br />capita allocation formula for participation in the 1976 State Park Bond Act, and requested approval from the City <br />Council that they continue to endorse a per capita distribution formula, as outlined in Resolution No. 3669, to be <br />presented to the County Board of Supervisors. <br />Moved by Mayor Beltran, seconded by Councilman Rehrer, reaffirming the City's recommendation of a per capita alloca- <br />tion formula to disperse State Park Bond Act monies, as outlined in Resolution No. 3669, and authorizing the Acting <br />City Manager to so advise the County Board of Supervisors. Vote was unanimous. <br />Transportation <br />OMNITRANS <br />Mr. Johnsen read his memorandum dated April 5, 1977, regarding a request from the OMNITRANS Board of Directors for <br />an advance of funds from each member jurisdiction in order to continue operation and service of the system through <br />July 1, due to a delay in receiving the UMTA Section 5 Operating Funds for 1976-77, which is causing serious cash <br />flow problems for OMNITRANS. <br />APR 51977 <br />
