.MR <br />3 , <br />Councilwoman Cisneros felt that there have been sufficient meetings and hearings held on the planned projects, and <br />due to the time element and financial constraints, Council should authorize Staff to instruct the architect to <br />proceed with the revisions as outlined, and take into consideration the suggestions as made by the Loma Linda <br />Medical Clinic for the Multi -Service Center. Mrs. Cisneros also commended Mr. de la Cerda and the Commission for <br />their dedicated work and efforts„ <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, authorizing Staff to instruct the architect to proceed <br />with the recommendations and revisions of the Planned Projects as outlined by Staff, and to take into consideration <br />the suggestions as submitted by the Loma Linda Medical Clinic for the Multi -Service Center. Vote was unanimous. <br />Housing Rehabilitation Program <br />Mr. de la Cerda advised the Council Members that two public hearings have been held on the third year funding <br />applications to HUD, and reported that discussions and recommendations include strong support for a housing rehabili- <br />tation program, establishing a fund for grants to homeowners, and budget allocations for the Fiscal Year 1977-78 <br />for Personnel and Operating Expenses. <br />Mr. de la Cerda concluded that another public hearing is scheduled for Thursday, January 20, 1977. <br />CORRESPONDENCE: <br />Library <br />Councilman Rehrer read his memorandum regarding the purchase of a plaque for the City Library, designating the <br />building as an historical site of Colton, and referred to a copy of the proposed wording to be inscribed on the <br />plaque. <br />Councilman Rehrer advised that the size of the plaque and number of letters will determine the eventual cost, and <br />if the proposed wording is approved this evening, a resolution will be prepared for approval by the City Council at <br />the next regular meeting. <br />Councilwoman Cisneros felt that the wording following the name LEROY "BUD" REHRER was too excessive, and that the <br />title of Councilman was sufficient. Mrs. Cisneros stated this may aid in a saving of funds toward the plaque. <br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to approve wording of Plaque for the Colton Library, <br />with suggested deletion of words as made. Motion carried, with Councilman Rehrer abstaining. <br />Personnel <br />Civil Service Board <br />City Manager Huffaker reported from his memorandum, and attached correspondence, regarding the dismissal of Mr. Howard <br />Heimbecker and hearings that were conducted by the Civil Service Board on the Appeal filed by Mr. Heimbecker, and <br />the Board's recommendations for reinstatement of the employee. <br />Mr. Huffaker advised that at a Special Meeting of the Civil Service Board, held January 5, 1977, the Board unanimous- <br />ly voted to recommend reinstatement of Mr. Heimbecker, effective December 6, 1976. <br />City Attorney Edwards advised that Mr. William J. Brunick, Attorney representing Mr. Heimbecker, has stated that Mr. <br />Heimbecker is willing to waive back wages, and then asked Mr. Heimbecker if this is so. <br />Mr. Heimbecker replied yes, on the advice of legal counsel. <br />Mr. Robert L. Daugherty, Employee Representative of the San Bernardino Public Employees Association, spoke on behalf <br />of Mr. Heimbecker, stating inasmuch as the employee has agreed to waive back pay in order to return to work, and the <br />Civil Service Board, at two separate meetings, unanimously voted to recommend reinstatement of Mr. Heimbecker, Mr. <br />Daugherty said he would respectfully request that the City Council seriously consider removing any and all material <br />and correspondence relating to this incident from the Personnel File of Mr. Heimbecker. <br />Mr. Huffaker said he would recommend denial of this request. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to reinstate Mr. Howard Heimbecker to his position of <br />Water Quality Control Plant Operator, effective January 19, 1977, with the provision that any back pay be waived. <br />Before the voting, Mayor Pro Tem Gonzales asked Councilman Hayes if he also wished to include in his motion the <br />portion relating to removal of this incident from the employee's Personnel File. <br />Councilman Hayes questioned the legality of this procedure. <br />City Attorney Edwards stated that, this would be at the discretion of the City Council, and that they can take <br />whatever action they so desire. <br />Councilman Rehrer felt that this could not actually be done, inasmuch as this incident covered a period of over two <br />months, the individual had not received pay during this interim and, therefore, there would have to be a record of these <br />events and proceedings. <br />Councilman Hayes stated he would withdraw his motion, and Councilwoman Cisneros stated she would withdraw her <br />second to the motion. <br />Mayor Pro Tem Gonzales stated he felt this information and material should be removed from the employee's Personnel <br />File. Mr. Gonzales said the Minutes of the meetings held by the Civil Service Board reflect that Mr. Heimbecker <br />was not found guilty, reinstatement was unanimously recommended, and he, therefore, feels that this matter should <br />be stricken from the employee's record as it could be detrimental to him in the future. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to reinstate Mr. Howard Heimbecker to his position of <br />Water Quality Control Plant Operator, effective January 19, 1977, waiving back pay, and that any and all information <br />or correspondence relating to this incident be removed from this employee's Personnel File.
