Motion carried. Councilwoman Cisneros voting NO. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />PUBLIC HEARING: <br />ORDINANCE NO. 1539 <br />Mobile Home Rent Review Com. <br />City Attorney Edwards reported from his memorandum dated June 28, 1978, stating the <br />Council, at their meeting of June 19, 1978, acted to reconsider adoption of Ordinance <br />No. 1539, entitled "An Ordinance of the City Council of the City of Colton, State of <br />California Establishing a Mobile Home Rent Review Commission", the ordinance has <br />been previously introduced, so this is second reading. Mr. Edwards stated a procedure <br />for hearing is included in the Council's agenda material, after conducting the <br />hearing the matter will be before the Council for action. <br />Mayor Gonzales announced the time and place fixed for the hearing with regard to <br />rents in mobile home parks. Mayor Gonzales asked all persons who expect to address <br />the Council to stand for an indication of how many people will be speaking for or <br />Q) against the ordinance. <br />o) Eight persons stood up to be recognized. Mayor Gonzales asked for <br />o)9 y the staff <br />Q presentation. <br />Q Planning Director Gonzales presented a staff report consisting of Mobile Home Park <br />Q Statistics with attachments A,B, C. and D prepared by members of of the Planning <br />Staff. Mr. Gonzales stated the full reports have been submitted in the Council <br />packets. <br />Mayor Gonzales stated the proponents for the ordinance would be heard first. <br />Those residents of Lake Cadena Mobile Home Park speaking in favor were: <br />Mrs. Phyllis Brooks, Mrs. Virginia Campher, Mr. Thomas Lee, Mrs. Eleanor Aguilar, <br />Ms. Skipper Aslin, Mr. John Collins, Mr. Harrington, and Ms. Gerry Ander of Del <br />Ripple. <br />The proponents talked about unfair rent increases, a fair profit return, free <br />enterprise, consumer protection, the high costs of relocating mobile homes, and <br />non-cooperation of the mobile home park owner. The proponents charged the Council <br />with indecision and delay and asked for immediate approval of the ordinance. <br />Attorney Brent Swanson, representing J. F. Shea Corporation, owners of Lake <br />Cadena Mobile Home Park, spoke in opposition to the ordinance. Mr. Swanson gave <br />each member of the Council a packet prepared for this meeting consisting of some <br />new documents, reference to previous documents submitted and a cover letter <br />summarizing the contents as all previous correspondence, two petitions, transcripts <br />of two past Council Meetings, a new marketing survey of rent increases, and two <br />documents from the Secretary Treasurer of J. F. Shea Corporation which indicates <br />that as of the end of June the park is operating at a loss and it is projected that <br />at the end of this year it will also be operating at a loss; and a document that <br />indicates there are 13 mobile home parks that were not included in the City's <br />staff report. <br />Mr. Swanson stated that the Staff report is inadequate, incomplete, and meaningless; <br />that the Council still does not have sufficient factual proof to meet the legal <br />requirements of the State or Supreme Court, and that the ordinance is unwarranted <br />interference. <br />Mr. Joe Bondaman, 1265 Kendall Drive, San Bernardino, with a firm of Planners, <br />and Architect Engineers, stated after hearing both sides tonight, he is philosoph- <br />ically against rent control, however, he is not present either for or against it. <br />Mr. Bondaman spoke with regards to looking out for their clients interest, who <br />presently is intending to develop a mobile home park in Colton and might hesitate to <br />proceed if direct rent control restrictions are approved. <br />Mr. Bondaman stated the Council has been deliberating the issue for four months <br />and that to him that is not a long time to deliberate on such an important issue <br />and that the Council should take a lot of time, care, and attention. <br />Mr. Thomas Lee and Mr. Dustin Harris spoke in closing statements.
