2 6 8 Mr. Gonzales advised the proposed use should create less traffic noise and other
<br />effects on the surrounding neighborhood than those created by the school use.
<br />Mr. Gonzales said the Planning Commission held a public hearing on this matter,
<br />June 26, 1979, and recommended approval of the Conditional Use Permit applica-
<br />tion, subject to findings and one condition as outlined in Planning Commission
<br />Resolution No. 920.
<br />Mrs. Rita Miller, 1412 Miller Drive, Colton, and Mrs. Ralph Guyaux, 16955 Washington
<br />Street, Colton, spoke in opposition to the proposed use of Washington School as a
<br />facility for abused and battered women and their children, stating this type of an
<br />operation and facility can apply for and receive federal funding for their project,
<br />the City will be impeding law enforcement and, in actuality, be assisting the
<br />batterer, and the proposed project is not a desirable use for the neighborhood.
<br />Mr. Ray Abril, Jr., 330 East N Street, Colton, spoke in favor of the proposed opera-
<br />tion and the work that is being done by the Central Valley Mental Health Association.
<br />Mr. Emil Fietz, past President of the Central Valley Mental Health Association, spoke
<br />on behalf of the Association and the proposed project, utilizing Washington School,
<br />advising that the Association intends to provide services for approximately 54 people
<br />at the school, and they will maintain the entire area, building, grounds, etc. Mr.
<br />Fietz said the Association will provide a person on the premises at all times, 7 days
<br />a week, 24 hours a day.
<br />After additional discussion with regard to the proposed project, use of the school
<br />facility and funding for the operation, moved by Councilwoman Cisneros, seconded
<br />by Mayor Gonzales, to approve Planning Commission Resolution No. 920, subject to
<br />findings and conditions, Index No. C-6-79. Upon Roll Call, the Vote was:
<br />AYES: Three; Cisneros, Gonzales, Hayes.
<br />NOES: Two; Rehrer, Temby.
<br />ABSENT: None.

<br />Variance

<br />Mr. Gonzales reported from his memorandum dated June 27, 1979, regarding a Variance
<br />application requested by John C. Heers, Inc., to allow reduction in side yard set-
<br />backs and permit the construction of a second building at 1450 East Cooley Drive,
<br />with the proposed building having a 15 foot setback on the east side and a 40 foot
<br />setback on the west side.
<br />Mr. Gonzales advised the proposed project is located in an area designated as in-
<br />dustrial office by the Cooley Ranch Master Plan, and the project site is governed
<br />by the Cooley Ranch Master Plan and Ordinance No. 1450, outlining the Cooley Ranch
<br />Development Standards. Mr. Gonzales stated the proposed building would be located
<br />on a site with an existing industrial office use which does meet the Cooley Ranch
<br />setback standards. The subject property does not possess any exceptional or extra-
<br />ordinary circumstances.
<br />Mr. Gonzales concluded the Planning Commission held a public hearing on this matter,
<br />June 26, 1979, and recommended denial of the Variance application due to the find-
<br />ings as outlined in Planning Commission Resolution No. 921.
<br />Mr. Bill Addington, representing John C. Heers, Inc., displayed a plot plan and
<br />rendering of the proposed building to the Council Members, outlining the uses in
<br />the immediate area and other industrial buildings having 15 foot setbacks as well.
<br />Mayor Gonzales read in full a letter from the Chamber of Commerce recommending ap-
<br />proval of the Variance application and proposed project.
<br />Councilwoman Cisneros felt this matter should be referred back to the Planning
<br />Commission, and provide the applicant the opportunity to show the Commissioners
<br />these exhibits as well, and to take another look at this matter.
<br />After additional discussion, moved by Councilman Temby, seconded by Councilman
<br />Hayes, to deny Planning Commission Resolution No. 921, and approve Variance ap-
<br />plication, Index No. V-6-79. Motion carried, with Councilwoman Cisneros voting
<br />NO.
