Duncan vs. City of Colton. <br />Recommend denial. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to approve the Consent <br />Calendar as outlined. Unanimous vote. <br />MAYOR'S REPORTS AND PROCLAMATIONS: <br />Proclamations <br />Mayor Pro -Tem Rehrer read in full a Proclamation honoring Older Americans Week, <br />June 17 through 23, 1979, which was presented to Mr. Tom Dixon. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Zoning/Land Use Element <br />P. C. Res. No. 916 <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, to set for Public <br />Hearing on Tuesday, July 3, 1979, Planning Commission Resolution No. 916. Vote <br />was unanimous. <br />Variance <br />P. C. Res. No. 917 <br />Planning Director Gonzales reported on a Variance application, requested by El <br />Norah M. Saffel, to allow encroachment into the side and rear yard setback areas <br />on property located at 1135 Bonita Drive, Index No. V-5-79. <br />Mr. Gonzales advised that the applicatn has constructed an aluminum cover over the <br />side and rear yard areas adjacent to the garage, however, the projection of this <br />cover into the required side and rear yard setback areas is in violation of Section <br />18.10.O10B of the Colton Municipal Code and Section 500 (2) of the Zoning Ordinance. <br />The applicant, having already constructed the subject cover, has requested the <br />Variance to permit the cover to remain within the side and rear setback areas. <br />Mr. Gonzales continued the applicant surveyed the affected neighbors and received <br />their approval to construct the subject cover as it now stands, however, upon com- <br />pletion of the cover, the neighbor to the south issued a complaint to the City re- <br />garding the placement of supports on a common wall, stating their fear that drain- <br />age from the structure might fall onto their yard. Mr. Gonzales advised the appli- <br />cant has indicatedto Staff that the wall supports are temporary and has agreed to <br />move the structure back six inches, and a drain has been provided to assure no run- <br />off will fall into the neighbor's yard. <br />Mr. Gonzales stated the Planning Commission held a public hearing on this matter, <br />June 12, 1979, and recommend approval of the Variance application, subject to <br />four conditions as outlined in Planning Commission Resolution No. 917. <br />Councilman Hayes requested an Executive Session to discuss matters of possible <br />Litigation. <br />EXECUTIVE SESSION: <br />The City Council adjourned to Executive Session at 7:47 p. m., to discuss matters <br />of possible Litigation, and reconvenedat 7:53 p. m., all Members present. <br />Moved by CouncilwomanCisneros, seconded by Councilman Temby, to approve Planning <br />Commission Resolution No. 917,.subject to fourconditions as listed, and adopting <br />findings as outlined therein. Motion carried, with Councilman Hayes voting NO. <br />Planning Files <br />Building Security Ordinance <br />Mr. Gonzales reported on the proposed Building Security Ordinance, advising that <br />pursuant to the City Council's request, the Planning Commission held a public <br />JUN 19 1979 <br />
