328Trart Film <br />Mr. Elliott advised that all cash fees, bonding and subdivision agreements have been <br />received for Tract No. 10026, and Staff therefore recommends approval of the tract. <br />Mr. Daniel Burnett, City Engineer, stated that Tract No. 10026 is a 37 -lot subdivi- <br />sion, not an 8 -lot subdivision, as indicated in a memorandum dated October 11, 1979. <br />Moved by Councilman Temby, seconded by Councilman Rehrer, to approve Tract No. <br />10026. Vote was unanimous. <br />CITY ATTORNEY'S REPORTS AND RECOMMENDATIONS: <br />_Ordinance No. 1572 <br />First Reading <br />City Attorney Edwards advised that Item Nos. 15 and 16 are being removed from the <br />Agenda, and read the following report in their place: <br />On October 15, 1979, Staff met and discussed the procedure for fixing the compensa- <br />tion of the City Clerk and City Treasurer. <br />Staff recommends the following: <br />1. Amend the current Ordinance to provide that supplemental compensation to <br />the salary fixed therein may be provided by resolution of the City Council. <br />2. Adopt a resolution fixing supplemental compensation. The resolution would <br />fix those sums at the difference between the total now paid and the respec- <br />tive ordinance amounts. It would ratify such payments from July 1, 1979, <br />when the current cost of living adjustment was made. <br />If the Council agrees, the action tonight would be the introduction of Ordinance No. <br />1572. Adoption of the Ordinance and the Resolution would follow at the next Council <br />Meeting. <br />Councilman Hayes asked City Clerk Ramos what effect this amendment will have on <br />Ordinance No. 829. <br />City Clerk Ramos responded the basic difference will be in the addition of the <br />sentence - "The City Council may provide by resolution for supplemental compen- <br />sation." - which has, in the past, been understood to be permitted by the Govern- <br />ment Code. Mrs. Ramos said this addition now clarifies the procedure for the <br />City Council and City Attorney. <br />Mayor Gonzales asked City Treasurer Margaret Berkebile if she was in agreement <br />with the proposed ordinance. <br />Mrs. Berkebile responded from the audience, yes, she was in agreement. <br />City Attorney Edwards introduced Ordinance No. 1572 for First Reading, reading it <br />as to number and title only: <br />ORDINANCE NO. 1572 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON AMENDING <br />First Reading SECTIONS 1 AND 2 OF ORDINANCE NO. 829. <br />Moved by Councilman Hayes, seconded by Mayor Gonzales, approving First Reading of <br />Ordinance No. 1572 and waiving further reading. Vote was unanimous. <br />Legal <br />City Attorney Edwards reported on a suit brought by John Coelho against various <br />Colton Police Officers arising out of the arrest of Mr. Coelho several years <br />ago. <br />Mr. Edwards advised that after consultation with the Mayor and Acting City Manager <br />on this item, he referred the matter to the law firm of Best, Best & Krieger as <br />the nature of this case falls within the area of expertise of the Federal litiga- <br />tion department of that law firm. <br />Mr. Edwards concluded Staff recommendation is motion action by the City Council <br />approving authorization for Best, Best & Krieger to defend the action on behalf <br />of the police officers. <br />OCT 16 1979 <br />
