Mr. Gonzales advised that Mr. Carnero proposes to construct a room addition, 20 3241' <br />feet by 26 feet, to the rear of the existing house, which would leave a rear <br />yard setback of 18 feet, and this is contrary to Section 18.10.050 of the Colton <br />Municipal Code which states that every lot and every parcel of land in an R-1 <br />zone shall have a rear yard not less than 25 feet in depth. Mr. Gonzales said <br />all of the adjacent lots to the subject property meet the required R-1 setback <br />requirements. <br />Mr. Gonzales stated the Planning Commission held a public hearing on this matter, <br />October 9, 1979, and recommended denial of the Variance application due to four <br />findings as listed in Planning Commission Resolution No. 928. <br />Mr. Gonzales concluded that Mr. Carnero is in the audience this evening and would <br />like to address the City Council. <br />Mr. Richard G. Carnero, 2211 Vermont Avenue, Colton, stated that he has revised <br />the plans to a 4 foot setback instead of the 7 foot setback previously requested, <br />which would provide a rear yard setback of 21 feet. <br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, to deny Planning <br />Commission Resolution No. 928 and approve Variance application requested by Mr. <br />Richard G. Carnero. Vote was unanimous. <br />(Y� MAYOR'S REPORTS AND PROCLAMATIONS: <br />Governmental Agencies <br />County Department of Mental Health <br />Q Mayor Gonzales stated there will be a deviation from the Agenda at this point for <br />a presentation from the County Department of Mental Health. <br />Melinda Rhinehart, representing the San Bernardino County Department of Mental <br />Health, invited the Council Members to tour their new facilities located at the <br />Ujima Counseling Center, 7084 North Sierra Avenue, Fontana, and to the Open House <br />on Friday, October 19, 1979, from 12:00 Noon to 4:00 p. m., with a buffet at <br />12:00 Noon. <br />Toastmasters Club <br />Ruthie Buchanan, representing the Toastmasters Clubs in the Inland Empire, accept- <br />ed the Proclamation read previously by Mayor Gonzales, and invited the City of <br />Colton to participate in the Toastmasters Clubs. <br />PLANNING COMMISSION REPORTS AND RECOMMENDATIONS: <br />Planning Case Files <br />Mobile Home Use <br />Planning Director Gonzales advised that Henry A. Gonzales has submitted a letter <br />with plot plan requesting permission to utilize a mobile home as temporary office <br />facilities at 1198 South Rancho Avenue. Mr. Gonzales said Staff recommends approval <br />of the request pursuant to the provisions of Section 18.32.070 of the Colton Muni- <br />cipal Code. <br />Moved by Councilman Hayes, seconded by Councilwoman Cisneros, approving request of <br />Henry Gonzales for use of a mobile home as temporary office facilities as outlined. <br />Vote was unanimous. <br />COMMUNITY SERVICES DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Agreements <br />Acting City Manager Elliott presented to the Council Members for their considera- <br />tion and approval two agreements between the City of Colton and the Atchison, <br />Topeka and Santa Fe and Southern Pacific Railroads, permitting the City to cross: <br />the railroad tracks with a proposed 16 -inch water line, and Resolution No. 3940, <br />authorizing the Mayor and City Clerk to execute these agreements. <br />Moved by Councilwoman Cisneros, seconded by Councilman Hayes, approving agreements <br />with Atchison, Topeka and Santa Fe and Southern Pacific Railroads, and Resolution <br />No. 3940.
