Special Assessments <br />375 <br />Assessment District No. 78-2 <br />Mayor Gonzales declared the Public Hearing open. <br />City Clerk Ramos submitted the Affidavit of Publication, reported on the Mailing <br />of Notice of Condemnation Hearing to property owners, and stated that no protests <br />or objections had been received. <br />Mr. John Brown, representing Best, Best & Krieger, stated the public hearing this <br />evening concerns the acquisition of the right-of-way at the corner of Washington <br />Street and Mt. Vernon Avenue in the Cooley Ranch area as part of Assessment Dis- <br />trict No. 78-2 proceedings. Mr. Brown indicated the purpose of the hearing this <br />evening is to give the property owner of that parcel the opportunity to appear <br />and be heard on this matter. <br />Mr. Brown said after the Council has adopted the resolution this evening, we can <br />then proceed with the posting of money with Superior Court of the State of Cali- <br />fornia and acquire the property necessary for the right-of-way to extend and ex- <br />pand Washington Street and Mt. Vernon Avenue in the Cooley Ranch area. <br />Mayor Gonzales asked if anyone desired to speak on this matter. <br />(Y) Moved by Councilman Rehrer, seconded by Councilman Hayes, to terminate the Public <br />(37) Hearing. Unanimous vote. <br />Moved by Councilman Rehrer, seconded by Councilman Hayes, to approve Resolution <br />No. 3980. Unanimous vote. <br />Q <br />RESOLUTION NO. 3980 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLTON DE- <br />CLARING THAT THE ACQUISITION FOR PUBLIC USE OF FEE SIMPLE <br />INTERESTS IN REAL PROPERTY, AN EASEMENT FOR ROAD AND UTILI- <br />TIES PURPOSES AND RIGHTS-OF-WAY UPON AND ACROSS CERTAIN <br />REAL PROPERTY BY EMINENT DOMAIN IS NECESSARY FOR THE IN- <br />STALLATION OF CERTAIN PUBLIC STREET IMPROVEMENTS. <br />CORRESPONDENCE: <br />Finance/Bonds <br />Mayor Gonzales referred to a memorandum from the City Treasurer, and attached <br />correspondence, regarding her recommendation to purchase ten bonds, available <br />to the City at a substantial discount, on the City of Colton Improvement Bond, <br />Assessment District No. 76-1. The purchase price is $8,225. <br />Mayor Gonzales stated that Mrs. Berkebile's memorandum also stated she would <br />like to be able to inform Mr. Doyle, of Stone & Youngberg, that the City will <br />purchase these bonds, by Wednesday, February 20, in order to obtain them be- <br />fore they can be sold elsewhere. <br />Mayor Gonzales concluded these memorandums had been sent to the Acting Finance <br />Director, Ruby Andengaard, with copies to the Mayor and City Manager. <br />City Manager Gonzales stated it has been the practice of the City in the past <br />that matters of this nature are to be brought to the Finance Director, and the <br />Finance Director in turn discusses this with the City Manager, a decision is <br />made administratively as to whether to purchase the bonds or not. <br />Mrs. Berkebile stated this matter was brought to the attention of the Acting <br />Finance Director by memorandums dated February 15 and 19, with copies to the <br />City Manager and Mayor. Mrs. Berkebile advised that she had just received <br />Mr. Doyle's letter today. <br />City Manager Gonzales responded then what is this doing here tonight in front <br />of the Council, Mrs. Berkebile. <br />Mrs. Berkebile stated she has merely made a recommendation on the purchase of <br />bonds to the City Council, at a substantial savings to the City. Mrs. Berkebile <br />said if the City Council does not wish to act on this matter, that is up to them, <br />however, she felt she should bring this matter to their attention for considera- <br />tion. <br />Councilwoman Cisneros moved that this matter be referred back to Staff for review <br />and recommendation to the City Council.
