<br />City Clerk Ramos announced that the Notice of Hearings, as required by law, has
<br />been given in the manner and forms required and the following Affidavits are on
<br />file in the Office of the City Clerk:

<br />2. Certificate of Mailing Notice and Filing Boundary Map
<br />3. Affidavit of Publication of Notice of Improvement
<br />4. Affidavit of Publication of Notice Inviting Sealed Bids
<br />5. Affidavit of Posting Notice Inviting Sealed Bids
<br />6. Certificate of Mailing Notice of Hearing on Necessity to Condemn
<br />Mr. F. MacKenzie Brown, Legal Counsel for Assessment District No. 78-2, reviewed
<br />Council actions taken at a previous Council Meeting by approving resolutions,
<br />authorizing the advertisement for bids on the works of improvements, which were
<br />received on January 24, 1980, and approved the Preliminary Engineer's Report,
<br />setting this matter for public hearing this evening.
<br />Mr. Brown continued that in order to accomplish the works of improvements it is
<br />necessary that certain rights-of-way and easements be obtained that were not in
<br />the possession of the City at that time, and the second public hearing will relate
<br />to the adoption of a resolution of necessity ordering eminent domain proceedings
<br />for all lands and easements still not obtained.
<br />Mr. Charles Cole, representing W. R. Showalter & Associates, gave the Engineer's
<br />Report, summarizing the method and formula used in the spread of assessment. Mr.
<br />Cole advised there are two contracts on this project, Contract "A" and Contract
<br />"B", and gave the confirmed cost of the contracts as $2,709,404.25 and $360,623.00
<br />respectively, reducing the net assessment from $6,064,851.69 to $4,928,242.89, which
<br />is approximately an 18 percent decrease in the preliminarily approved budget.
<br />Mr. Cole continued there are no major changes in the order of work, the spread of
<br />assessments has been done by the firm of Neste, Brudin & Stone, and was accomplished
<br />in accordance with the formula as set forth in the preliminary approved Engineer's
<br />Report, and will follow through to the final report.
<br />Mr. Brown then asked City Clerk Ramos if any written protests had been received.
<br />City Clerk Ramos answered no, there were no written protests received.
<br />Mr. Brown then indicated to Mayor Gonzales it would now be in order to open the
<br />hearing to public discussion.
<br />Mr. William E. Ashley, Jr., 736 North La Cadena Drive, Colton, stated that he owned
<br />property within the assessment district and questioned the method of spread of the
<br />assessment. Mr. Ashley asked if the utility assessment on this property was paid
<br />for, along with other improvements, and, if so, would there be some sort of credit
<br />applied against this assessment.
<br />Mr. Daniel H. Burnett, Jr., Assessment Engineer, of Neste, Brudin & Stone, told
<br />Mr. Ashley his particular piece of property included credit for a water assess-
<br />ment. Mr. Burnett explained this project consists of three different assessments,
<br />a water assessment - which is spread against the entire ranch at a charge of
<br />$2,828. per acre; a general street and storm drain improvement benefit - which is
<br />spread against all of the land south of the existing Reche Canyon Channel at a
<br />charge of $13,157. per acre; and a local improvement benefit, the properties
<br />fronting along Washington Street which will have an additional assessment for
<br />street improvements, at a charge of $154. per lineal foot.
<br />Mr. Jim Phillips stated he has purchased a condominium in the Cooley Ranch area,
<br />and he did not feel that the improvement of Washington Street, or the improve-
<br />ments south of the Reche Canyon Channel, would be of any benefit to the condo-
<br />minium owners and he did not feel they should be assessed for it.
<br />Mr. Tom Villelli, developer of the Cooley Ranch area, thanked everyone for their
<br />diligent work in getting the last assessment district together, stating this was
<br />something that was badly needed for a long time. Mr. Villelli stated there are
<br />five new developments ready to begin as soon as the highway has been completed,
<br />so the City will see some major projects in that area very soon. Mr. Villelli
<br />also stated it is his understanding that in the case where properties already
<br />have buildings standing on them, as soon as those buildings have been assessed
<br />by the County Assessor and the taxes begin to acrue, in most instances the
<br />property taxes will retire in bond payments.
