w <br />The City Council recessed at 8:05 . m., and reconvened at 8:17 . m., all Member��s� <br />P p <br />present. <br />Mr. Douglas Dever, Attorney for Torino Industries of Torrance, spoke to the Council <br />regarding the projects in the City being developed by Torino Industries, their al- <br />location of sewer connections, possible additional necessary financing, other tracts <br />being developed in the City, and the requirements concerning off-site improvements. <br />City Attorney Edwards stated the comments regarding the allocations in Catagory 3 <br />is a very difficult matter and is going to require taking a close look at the facts <br />as to each different project. Mr. Edwards continued this, however, is not being <br />done tonight. Mr. Edwards said a hearing will be set at which time these alloca- <br />tions will be discussed and Staff will present a specific recommendation for the <br />first allocation in Catagory 3. Mr. Edwards stated those present at the hearing <br />will be given copies of Staff's recommendations, the Council will hear your con- <br />tention as to whether or not the recommendations are agreeable, and after hearing <br />all parties, the City Council will make a determination. <br />Mr. Edwards said granted these things are difficult and we cannot pre -judge them, <br />however, the job tonight is to set a general way of approaching it and then look <br />at it specifically. Mr. Edwards continued to bear in mind that the allocations <br />will be made periodically, it is not going to be a one-shot thing, every three <br />months there will be a hearing and a new allocation will be made. Mr. Edwards <br />(� said there will be alot of guess work involved as to when certain developers will <br />be ready to use their allocations, and there is a provision made that if there is <br />an allocation and it cannot be used, then it drops back into the "pool" and is <br />looked at the next time around. <br />Mr. Vince Mayell, of Newport Beach, stated he is the owner of Tract No. 10585, <br />which is almost ready for a record map, based upon approvals of a tentative tract <br />map and a conditional use permit, and he is concerned about the expiration of the <br />tentative tract map and conditional use permit, and was wondering if the Council <br />is going to make some kind of provisions for extensions of those permits, so that <br />he would not have to go through the whole procedure again and process for approval. <br />City Attorney Edwards stated that Mr. Mayell has an excellent point, and he felt <br />that he, Mr. Mayell and the City Manager should get together and discuss this <br />matter in greater detail. <br />Mr. Doug Gfeller, of Gfeller Development in Irvine, spoke to the City Council about <br />the five tracts being developed by his company in Colton, and asked about a previous <br />ordinance adopted by the City Council which does not allow the recording of any <br />maps due to the lack of issuing sewer permits and, along with the adoption of this <br />ordinance this evening, what is that going to do about recording maps? Mr. Gfeller <br />asked if the City Council will allow a map to be recorded even if it does not have <br />a sewer permit allocated to it? <br />Mr. Gfeller continued that many of the developers with large parcels would like to <br />be able to record the final maps and begin with the grading and off-site improvements, <br />knowing that there is still considerable time before coming to the City for a build- <br />ing permit, at which point there would be a hold up waiting for a sewer allocation. <br />Mr. Gfeller stated under this ordinance it is not clear how you would treat that <br />sort of action, whether a developer would be allowed to go ahead and record a final <br />map and proceed with grading and improvement plans, but not proceed with building <br />permits. <br />City Attorney Edwards responded he sees no reason to prevent maps from being re- <br />corded and he felt that could be permitted. Mr. Edwards said furthermore, with <br />proper documentation, he saw no problems with starting the work, even though it <br />is not assured that a sewer connection allocation would be made at a certain <br />point in time. <br />Mr. Mayell then asked about the renovation of the sewer plant and when could com- <br />pletion of the plant be expected. <br />City Manager Trevino asnwered the work at the plant is being done by Krieger and <br />Stewart and the City has been given a possible completion date of August, 1981, <br />with of course approval from the Water Quality Control Board. <br />Mayor Gonzales asked if anyone else desired to speak on this matter.
