Unanimous vote. <br />nrdi nanrAc <br />Summary <br />City Attorney Edwards stated this item deals with the procedure for publication of <br />ordinances. Mr. Edwards advised that in the past all ordinances were published in <br />the newspaper in full after adoption, and now an alternate procedure is available, <br />which allows for a summary only to be published, rather than an entire ordinance. <br />Mr. Edwards continued where an ordinance is very lengthy, this can result in a <br />substantial savings. <br />Mr. Edwards stated that if the Council wishes to authorize the use of the alternate <br />procedure, it should designate a City official to prepare the summary. Mr. Edwards <br />said he is willing to do that if the Council wishes for him to do so. <br />Mr. Edwards concluded that Staff recommends it be authorized to use the new proce- <br />dure in selected instances, and that the City Attorney be designated as the official <br />to prepare the summaries. <br />Moved by Councilwoman Cisneros, seconded by Councilwoman Garcia, to approve staff's <br />recommendation as outlined by the City Attorney regarding publication of ordinal -Ices <br />by summary. Unanimous vote. <br />Ordinance No. 1594 <br />CityAttorney Edwards recommended that Ordinance No. 1594, an ordinance amending <br />sections of Chapter 18.29 of the Colton Municipal Code and Exhibit "A" of Ordi- <br />nance No. 1450, be set for public hearing on Tuesday, December 2, 1980. <br />Moved by Councilman Hayes, seconded by Councilwoman Garcia, to set for public hearing <br />on Tuesday, December 2, 1980, at 7:30 p. m., Ordinance No. 1594. Unanimous vote. <br />Ordinance No. 1595 <br />City Attorney Edwards introduced Ordinance No. 1595, an Emergency Ordinance, for <br />Council's consideration and approval: <br />ORDINANCE NO. 1595 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLTON ESTAB- <br />LISHING A PROCEDURE FOR ALLOCATION OF INTERIM SEWER CONNECTIONS <br />AVAILABLE PURSUANT TO COURT ORDER. <br />Mr. Edwards asked the City Council if they wished to have the ordinance read in <br />full. <br />On Council consensus, the Council Members responded yes. <br />City Attorney Edwards then read Ordinance No. 1595 in its entirety. <br />Moved by Councilwoman Garcia, seconded by Councilman Rehrer, to adopt Ordinance No. <br />1595. <br />Mayor Gonzales stated before the final voting on Ordinance No. 1595, possibly some <br />of those present this evening would like to make comments or have questions. <br />Mr. Dennis Tyler, Attorney for McKindle & Anderson of Newport Beach, asked if the <br />Council would go back through the Ordinance to that portion that set forth the <br />requirements of the Catagory 3 Priority, and also list the projects by owner or <br />subdivider that are shown on the Exhibit. <br />City Attorney Edwards advised that there are some copies of Ordinance No. 1595 <br />available and Exhibit B of the ordinance is Catagory 3. Mr. Edwards then referred <br />to two Court orders that were made, one was a temporary restraining order, and <br />second was a preliminary injunction. Mr. Edwards continued to qualify for Cata- <br />gory 3 a project must both have had a building permit at the time the first Court <br />order was made, and second have some substantial work accomplished as of the time <br />of the second Court order. <br />Attorney John Brown suggested that inasmuch as this was the first time that many <br />of these individuals have had the opportunity to review the Ordinance, possibly <br />the City Council could take a short recess to enable the people to look through <br />the copies of the Ordinance. <br />NOV i81980 <br />
