266 <br />stated they are willing to increase the fee from 3% to 5%, however, <br />they are asking that the existing franchise be transferred at this time, <br />and negotiate the other items at a later date. <br />Mayor Huntoon asked how far apart are we on an agreement. <br />Mr. Benest replied there are no complex issues and we are close to some <br />form of agreement. Mr. Benest stated the major issue is the production <br />studio and local programming. Mr. Benest said it might be possible to <br />transfer the existing franchise now and sit down later and work on the <br />other issues. <br />Mr. Frank Dominguez, President of Colton Cablevision, Inc., stated they <br />have invested many dollars in the City of Colton and their service is <br />the best in the area. Mr. Dominguez said they have provided some local <br />events, however, there is no support for local programming, it is not <br />feasible for the size of Colton. Mr. Dominguez stated the firm of <br />Daniels & Associates are very interested in supplying many services to <br />the City of Colton. Mr. Dominguez urged the Council to consider the <br />franchise transfer this evening. <br />Mayor Huntoon asked why do we have to approve the transfer of the <br />franchise tonight. Mayor Huntoon suggested the City wait on the <br />transfer until some of these other items can be worked out and we <br />are closer to an agreement. <br />Ms. Sharon Wilson, Director of Operations for Daniels & Associates, <br />Inc., stated they are very willing to negotiate, however, there are <br />regulatory issues involved and they need time to negotiate these items. <br />Ms. Wilson said they need to know if this is a good business venture <br />for them as well as the City of Colton. <br />Mayor Huntoon asked if anyone had additional comments to make. <br />Moved by Councilman Rehrer, seconded by Councilman Rios, the Public <br />Hearing was terminated. Unanimous vote. <br />Mr. Dominguez again asked the Council to consider the transfer of <br />franchise this evening to avoid any further delays and sale of Colton <br />Cablevision. <br />Mr. Benest stated with the exception of Item No. 3, the other items are <br />not major or costly items, and possibly the existing franchise could be <br />transferred as is, and then begin with negotiations. <br />City Attorney Edwards stated if the Council is desirous of considering <br />the transfer of franchise this evening, a resolution has been prepared <br />to accomplish this. Mr. Edwards then read Resolution No. R-157-86 in <br />its entirity. <br />Mr. Miller stated they had also prepared a resolution and they would <br />like to see the language of their resolution incorporated into the City's <br />resolution, if agreeable with the City. <br />Mr. Edwards asked to see a copy of their resolution, which was provided <br />to him by Mr. Miller. <br />Councilman Rehrer then stated that he would withdraw his motion to <br />close the Public Hearing, and suggested that this matter be continued. <br />After additional discussion, moved by Councilwoman Garcia, seconded by <br />Councilman Rios, the Public Hearing was terminated. Motion carried, <br />with Councilman Rehrer voting NO. <br />City Attorney Edwards then read the proposed resolution submitted by <br />Daniels & Associates .in full. Mr. Edwards stated he had no problem <br />with the resolution or its incorporation with the City's resolution. <br />Moved by Councilwoman Garcia, seconded by Councilman Rios, to approve <br />Resolution No. R-157-86, with additions, as outlined by the City At- <br />torney.
