126 <br />EMINENT DOMAIN PROCEEDINGS: <br />City Manager Leslie Keane reported the City has completed successful <br />negotiations for the nine acres on Rancho Avenue in the vicinity of <br />the City's Wastewater Treatment Plant, therefore, it is not necessary <br />to proceed with this matter. <br />COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS: <br />Mobile Home Park Rent Stabilization Ordinance <br />Mayor Gonzales stated the City Council will make a change in the Agenda <br />and now consider Item No. 26, the Mobile Home Park Rent Stabilization <br />Ordinance. <br />Community Development Director Jaime Aguilera reported due to California <br />Environmental Quality Act (CEQA) requirements, our Legal Counsel, John <br />Brown, of Best, Best & Krieger, felt the Ordinance should be reviewed <br />through the environmental process, and Council directed Staff to perform <br />an Environmental Review of•the�Ordinance. The environmental consulting <br />firm of Castaneda & Associates was hired and coordinated the entire <br />process through Best, Best & Krieger. After extensive research, Castaneda <br />and Associates and Mr. James Neuerburg, of Best, Best & Krieger, con- <br />cluded that a Negative Declaration should be prepared for the project. <br />Mr. Aguilera continued that Castaneda & Associates proceeded to notify <br />all concerned parties and requested that they submit comments to the <br />Community Development Department, one, of which, was received from <br />Hillary Willett. <br />Mr. Aguilera advised the Planning Commission heard the report from Staff <br />and reviewed the material from Castaneda & Associates. Ms. Willett <br />spoke at the meeting and stated she believed an Environmental Impact <br />Report should have been performed. _--- <br />Mr. Aguilera stated the Planning Commission found the Negative Declara- <br />tion to be sufficient, complete and in compliance with CEQA requirements <br />and, therefore, recommended a Negative Declaration for the Mobile Home <br />Park Rent Stabilization Ordinance be approved by the City Council. Our <br />Legal Counsel, Mr. Neuerburg, of Best, Best & Krieger, has thoroughly <br />reviewed the Ordinance and modified it slightly in order to withstand <br />any challenge by opposing parties, and also to address the concerns of <br />the mobile home park tenants and City officials. <br />Mr. Aguilera concluded Staff recommends the City Council instruct Staff <br />to comply with CEQA regulations regarding the posting, publishing and <br />notification of the intent to adopt a Negative Declaration, and further <br />that the City Council consider First Reading, and waive full reading, of <br />Ordinance No. 0-19-89. <br />Speaking in opposition to the proposed Ordinance were the following, <br />stating that this Ordinance will put the mobile home park owners out <br />of business, it will hold down development, the Ordinance will not <br />achieve the effect the City wants, the City's Housing Element has not <br />been updated and it is premature to consider this Ordinance, the City <br />Council should give serious consideration to an Environmental Impact <br />Report, this Ordinance will have a serious impact on long-term leases, <br />the proposed Ordinance in its present form will be an expensive process <br />for the City to carry out, and the City Council should not consider this- <br />Ordinance <br />hisOrdinance this evening and study it further: <br />Mr. Clay Hage, Western Mobilehome Association, 3773 Tibbetts Street, <br />Riverside, California. <br />Ms. Hillary Willett, Glenneyre Management, 1891 South Coast Highway, <br />Laguna Beach, California. <br />Mr. Lawrence Horwitz, Hart, King & Coldren, 200 East Sandpointe, St. B, <br />Santa Ana, California. <br />Mr. Phil Anthony, 2157 Pacific Avenue, B-203, Costa Mesa, California. <br />Speaking in favor of the proposed Ordinance, stating the continual in- <br />creases in their rental spaces is unfair and unjustified, many of the <br />parks are in need of improvements and repairs, people living on fixed <br />AUG 15 1989 <br />
