EMINENT DOMAIN PROCEEDINGS:
City Manager Leslie Keane reported the City has completed successful
negotiations for the nine acres on Rancho Avenue in the vicinity of
the City's Wastewater Treatment Plant, therefore, it is not necessary
to proceed with this matter.
COMMUNITY DEVELOPMENT DIRECTOR'S REPORTS AND RECOMMENDATIONS:
Mobile Home Park Rent Stabilization Ordinance
Mayor Gonzales stated the City Council will make a change in the Agenda
and now consider Item No. 26, the Mobile Home Park Rent Stabilization
Ordinance.
Community Development Director Jaime Aguilera reported due to California
Environmental Quality Act (CEQA) requirements, our Legal Counsel, John
Brown, of Best, Best & Krieger, felt the Ordinance should be reviewed
through the environmental process, and Council directed Staff to perform
an Environmental Review of•theOrdinance. The environmental consulting
firm of Castaneda & Associates was hired and coordinated the entire
process through Best, Best & Krieger. After extensive research, Castaneda
and Associates and Mr. James Neuerburg, of Best, Best & Krieger, con-
cluded that a Negative Declaration should be prepared for the project.
Mr. Aguilera continued that Castaneda & Associates proceeded to notify
all concerned parties and requested that they submit comments to the
Community Development Department, one, of which, was received from
Hillary Willett.
Mr. Aguilera advised the Planning Commission heard the report from Staff
and reviewed the material from Castaneda & Associates. Ms. Willett
spoke at the meeting and stated she believed an Environmental Impact
Report should have been performed. _---
Mr. Aguilera stated the Planning Commission found the Negative Declara-
tion to be sufficient, complete and in compliance with CEQA requirements
and, therefore, recommended a Negative Declaration for the Mobile Home
Park Rent Stabilization Ordinance be approved by the City Council. Our
Legal Counsel, Mr. Neuerburg, of Best, Best & Krieger, has thoroughly
reviewed the Ordinance and modified it slightly in order to withstand
any challenge by opposing parties, and also to address the concerns of
the mobile home park tenants and City officials.
Mr. Aguilera concluded Staff recommends the City Council instruct Staff
to comply with CEQA regulations regarding the posting, publishing and
notification of the intent to adopt a Negative Declaration, and further
that the City Council consider First Reading, and waive full reading, of
Ordinance No. 0-19-89.
Speaking in opposition to the proposed Ordinance were the following,
stating that this Ordinance will put the mobile home park owners out
of business, it will hold down development, the Ordinance will not
achieve the effect the City wants, the City's Housing Element has not
been updated and it is premature to consider this Ordinance, the City
Council should give serious consideration to an Environmental Impact
Report, this Ordinance will have a serious impact on long-term leases,
the proposed Ordinance in its present form will be an expensive process
for the City to carry out, and the City Council should not consider this-
Santa Ana, California.
Mr. Phil Anthony, 2157 Pacific Avenue, B-203, Costa Mesa, California.
Speaking in favor of the proposed Ordinance, stating the continual in-
creases in their rental spaces is unfair and unjustified, many of the
parks are in need of improvements and repairs, people living on fixed
