Recommend denial. <br />Moved by Councilwoman Cisneros, seconded by Councilman Rehrer, to ap- <br />prove the Consent Calendar, with the deletion of Item No. 7. Vote was <br />unanimous. <br />Rent Control Ordinance <br />Mayor Gonzales advised that we will deviate from the Agenda and now con- <br />sider Item No. 23, the Rent Control Ordinance. <br />Mr. John Brown, Legal Counsel, of Best, Best & Krieger, stated as Council <br />requested, the Mobile Home Rent Control Ordinance has been revised and <br />the following matters provided for: <br />1. The base year has been set as the year beginning January 1, 1987. <br />While a November date had previously been discussed, the calendar <br />year approach was taken to facilitate record keeping and computa- <br />tion of annual profits. <br />2. The administration of the ordinance has been placed under the gen- <br />eral direction of the Community Development Director. <br />3. A provision has been added prohibiting mobile park owners from <br />passing through registration fees to mobile home park tenants. <br />4. Provisions have been added clarifying rent review procedures, al- <br />lowing informal mediation by staff, formal hearing before a hearing <br />officer, and appeal to the Rent Control Commission. <br />5. A definition of "vacancy" has been added as well as a provision for <br />decontrol of rent when a vacancy occurs. <br />Mr. Brown also discussed the Space Rent Agreement Exemption, as outlined <br />on Page 5, Section 1.03 B., Exemptions From Coverage. Mr. Brown stated <br />the Council may wish to exclude this section from the ordinance, as <br />Mayor Gonzales has suggested. <br />Mayor Gonzales stated the reason he felt this should be excluded was <br />that this provision would not be of any help or assistance to the <br />tenants, especially in one of the parks in particular. <br />FEB 7 1989 <br />
